Man Charged Under Patriot Act for Laser

NEWARK, N.J. (AP) - A man charged with temporarily blinding the pilot and co-pilot of an airplane with a laser beam claims he was simply using the device to look at stars with his 7-year-old daughter.

Federal authorities on Tuesday used the Patriot Act to charge David Banach, 38, with interfering with the operator of a mass transportation vehicle and making false statements to the FBI. He is the first person arrested after a recent rash of reports around the nation of lasers being beamed at airplanes.

If convicted, Banach could be sentenced to 25 years in prison and fined $500,000.

The FBI acknowledged the incident had no connection to terrorism but called Banach's actions "foolhardy and negligent."

Banach, of suburban Parsippany, admitted to federal agents that he pointed the light beam at a jet and a helicopter over his home near Teterboro Airport last week, authorities said. Initially, he claimed his daughter aimed the device at the helicopter, they said.

Banach's lawyer said his statements were given during several hours of questioning without an attorney present and that he was being harshly prosecuted because authorities were eager for an arrest.

"My client is in some ways a sacrificial lamb," attorney Gina Mendola-Longarzo said. "A message is being sent."

The jet, a chartered Cessna Citation, was landing Dec. 29 with six people aboard when a green light beam struck the windshield three times at about 3,000 feet, according to court documents. The pilot and co-pilot were temporarily blinded but were able to land the plane safely.

Two days later, a Port Authority police helicopter trying to pinpoint the origin of the beam was hit by a laser. A copter crew member then shined a spotlight on the house where the beam had originated so that officers on the ground could go there. Soon afterward, FBI agents came to Banach's house, authorities said.

Mendola-Longarzo said her client was simply using the hand-held device to look at stars with his daughter on the family's deck. She said Banach bought the device on the Internet for $100 for his job testing fiber-optic cable.

"He wasn't trying to harm any person, any aircraft or anything like that," she said.

Joseph Billy, agent in charge of the FBI's Newark bureau, said Banach's actions endangered not only the jet's crew and passengers but also "countless innocent civilians on the ground in this densely populated area."

Banach, who was released on $100,000 bail, is charged only in connection with the jet. According to the FBI, the Patriot Act does not describe helicopters as "mass transportation vehicles."

Similar incidents have been reported in Colorado Springs, Colo., Cleveland, Washington, Houston and Medford, Ore., raising fears that the light beams could temporarily blind cockpit crews and lead to accidents.

Last month, the FBI and the Homeland Security Department sent a memo to law enforcement agencies saying there is evidence that terrorists have explored using lasers as weapons. But federal officials have said there is no evidence any the current incidents were part of a terrorist plot.

Three storms threaten to strike U.S. at once

"Somebody is in for something pretty darn interesting," Redmond said.

 

WASHINGTON — Moisture-laden storms from the north, west and south are likely to converge on much of America over the next several days in what could be a once-in-a-generation onslaught, meteorologists forecast yesterday.

If the gloomy computer models at the U.S. Climate Prediction Center are right, we'll see this terrible trio:

• The "Pineapple Express," a series of warm, wet storms heading east from Hawaii, drenching Southern California and the far Southwest, already beset with heavy rain and snow. Flooding, avalanches and mudslides are possible.

• An "Arctic Express," a mass of cold air chugging south from Alaska and Canada, bringing frigid air and potentially heavy snow and ice to the usually mild-wintered Pacific Northwest.

• An unnamed warm, moist storm system from the Gulf of Mexico drenching the already-saturated Ohio, Tennessee and Mississippi valleys. Expect heavy river flooding and springlike tornadoes.

Meteorologists caution that their predictions are only as good as their computer models. And forecasts are less accurate the further into the future they attempt to predict. "The models tend to overdo the formation of these really exciting weather formations for us," said Mike Wallace, a University of Washington atmospheric scientist.

Yet the more Wallace studied the models, the more he became convinced that something wicked was coming this way.

"It all fits together nicely," he said. "There's going to be weather in the headlines this weekend, that's for sure."

The National Weather Service yesterday issued a statement warning that several inches of snow could fall by the end of the weekend in the central Puget Sound lowlands, including Seattle. The snow could begin as soon as tomorrow night, particularly in areas north of Seattle, with a growing chance of snow farther south Friday, the weather service said. Highs through this weekend are expected to be in the low- to mid-30s, with lows in the mid- to high-20s.

"Don't sound the alarm," weather service meteorologist Johnny Burg said. "But tell everybody to just pay attention to future forecasts."

The three storms are likely to meet in the nation's midsection and cause even more problems, sparing only areas east of the Appalachian Mountains. Property damage and a few deaths are likely, forecasters said.

"You're talking a two- or three-times-a-century type of thing," said prediction-center senior meteorologist James Wagner, who has been forecasting storms since 1965. "It's a pattern that has a little bit of everything."

The exact time and place of the predicted 1-2-3 punch changes slightly with every new forecast. But the National Weather Service, in its weekly "hazards assessment," alerted meteorologists and disaster specialists yesterday that flooding and frigid weather could start as early as Friday and stretch into early next week, if not longer.

"It's a situation that looks pretty potent," said Ed O'Lenic, the Climate Prediction Center's operations chief. "A large part of North America looks like it's going to be affected."

Kelly Redmond, deputy director of the Western Regional Climate Center at the Desert Research Institute in Reno, Nev., where an unusual 18 inches of snow is on the ground, said the expected heavy Western rains could cause avalanches. Southern California and western Arizona have had three to four times the normal precipitation for the area since Oct. 1.

"Somebody is in for something pretty darn interesting," Redmond said.

I was coming home from work on the afternoon of December 27, 2004 down I-65 at around 6:00 p.m. when an object in the sky caught my eye. I quickly grabbed my camera from the back seat and managed to get one shot of it before it disappeared. The sky that day was clear without a single cloud. I can't say what it is but appears to be disk shaped. Its forward speed was slow if any. One second it was there....the next it was gone. Below is the photo in question.

The location of the sighting took place on interstate I-65 just on the outskirts of Creola, Alabama. My wife and I were headed south on I-65 bridge when I decided to stop and take a photo of the span.I've included the photo below. I have a 3.2 mp digital camera with a 10x optical zoom.Photo sizes are 2048x1536. I've resized this photo to 512x384 for the sake of e-mail.

After taking this photo I returned to my car and proceeded down the bridge. It was at this point that I spotted the object. It was WNW of my position at some miles out at a height between 15000 to 25000 feet at best guess.The object did not appear as normal air traffic as it did not move much if any. I really could not define the shape of the object with the naked eye .I pointed the object out to my wife....what is that? I don't know she replied. Hold the wheel I said as I reached in the back seat for the camera. It was at that point that I zoomed in, acquired focus and snapped a shot off. After lowering the camera and looking back to where it was.... it was no more...gone...vanished. Total sighting time was no more than 30 seconds...... if that. Here is a map showing the sighting location.

Why Does the Earth Shake?

The Talmud relates that Rabbi Katina once passed by the house of a certain necromancer (ba'al ov), when the earth suddenly shook. He called out, "Does the necromancer know what is the meaning of this rumbling?"

The medium responded: "Katina, Katina, why should I not know? When the Holy One remembers His children, who are in a state of suffering amongst the nations of the world, [it is as if] He lets two tears fall. When they hit the ocean, the sound is heard from one end of the world to the other. That is the rumble of an earthquake."

Rabbi Katina immediately called out, "The necromancer is a liar and his words are false. Were that the case, we should have heard two rumblings!"

In fact, there really were two rumblings of the earth, but Rabbi Katina did not want people to be led astray and follow the necromancer. (Brachot 59a)

This story raises many questions. What is the meaning of these two tears falling from heaven? What do the misfortunes of the Jewish people have to do with catastrophes in other parts of the world? And why does the Talmud emphasize that the source for this metaphysical explanation of earthquakes - an explanation that the Sages accepted - was a necromancer, a practitioner of witchcraft explicitly forbidden by the Torah, divination by communicating with the dead?

Purposeful Destruction

Just as many written symbols join together to comprise a book, so too, every event that occurs, even the most insignificant, plays its part in bringing the world towards its ultimate goal. And even in those events that appear to be obstacles to progress and defects in creation, we should recognize that "All that God does will be forever... God made it so that people should fear Him."
In other words, if we wish to reveal the purpose of destructive phenomena in the world, we must be able to evaluate their contribution towards developing humanity's ultimate morality and spiritual perfection.

The horror of an earthquake - which may uproot nations, wreak vast destruction and bury thousands of people - raises deep questions for people throughout the world. Events like these challenge us to fathom God's wisdom and providence in general, and the function of such terrible destruction in particular.

We may begin to answer these questions only after we recognize that the path to properly establishing mankind's ethical nature is a complex one. Human society is often plagued with many grave defects, faults so deeply ingrained that they cannot be rectified as long as society remains undisturbed. Only Divine wisdom can determine at what point the overall culture of humanity requires such a severe shake-up, disrupting the world's material and spiritual well-being, in order to allow for the necessary correction.

The Status of the Jewish People

How can the moral state of humanity be gauged? One indication is the relative status of the Jewish people. This nation, by virtue of its unique spiritual gifts to the world - the light of the Torah and the knowledge of one God - should be highly respected and honored among the nations. That this is not the case attests to serious defects in mankind, of which the Jewish people certainly contributes its portion. No one can rightfully claim that the Jewish people, with its special history and function in the world, deserves to be the subject of such baseless hatred and disgrace. The sorry state of the people of Israel reveals a deep moral deficiency in the world. It is a sign of many other defects that have been absorbed in the turbid nature of mankind - until Divine providence demands their redress, even by great upheaval, if necessary.

Two Divine Tears

Earthquakes are a vivid example of great upheaval. This terrible event is accompanied by a general descent in society; the material collapse leads to an ethical decline. The establishment of an organized and lawful society secures many moral benefits. When the overall goal decrees the uprooting of a large portion of humanity, it results in deterioration in both physical and spiritual realms.

This dual decline contradicts God's aspiration, Who desires the best for His creation; thus the Talmudic metaphor of two Divine tears, expressing pain and sorrow. Just as we cannot truly grasp the purpose for this destruction, so the tears drop into the ocean - their positive contribution is beyond our perception. The impact of this event, however, resounds throughout the world - "It is heard from one end of the world to the other" - through those ties that connect all nations together.

Theoretical Knowledge

It is true that upheaval may serve positive and corrective purposes. But this knowledge may only be used by the righteous and the pure-hearted. In the hands of the wicked, it becomes a tool of destruction, justifying the breakdown of all physical and spiritual good. The evil necromancer, who was not guided by the ideals of justice and truth, praised the value of upheaval. Yet, "he is a liar and his words are false," for we have no way to assess all of the results of such actions. In addition, the destruction must prepare the way for a new framework, and that is beyond our capabilities.

Rabbi Katina was right in rejecting the use of upheaval as a practical tool to better humanity. Its value is only theoretical, as a philosophical understanding of Divine providence over thousands of generations. Rabbi Katina rejected the necromancer's words so that people should not follow his mistaken ways and justify destructive acts. Such an approach is a spiritual disease and brings much evil into the world. The necromancer, who seeks to communicate with the dead, is like the anarchist who detests life and organized society. In fact, it is only through orderly life that humanity can realize its potential for good and righteousness.

Lessons From the Earthquake

The earthquake in Southeast Asia and the horrors it brought upon millions of people made all of mankind tremble, as well. Our sages ordained a special blessing for earthquakes, which they called in Hebrew zeva'ot, literally, "horrors": "Blessed is He whose power and might fill the earth." (Berachot 24) This is interpreted to mean: "Blessed is He who bestows power upon nature, thereby displaying the power of the Creator of the universe, so that mankind will revere Him." (see Mishnah Berurah, Orach Chaim 227:1)

We must understand reality on two levels: morally, and in terms of nature and causality. Understanding earthquakes the latter way means understanding that there is movement in the earth's crust. We see and understand what are the earthquake's horrifying results. We must learn and understand how to deal with earthquakes and their repercussions, so as to prevent future damage, etc. Yet, within this causal understanding, there is also understanding based on morality and ethics.

As our sages said: "Why do earthquakes occur? When G-d remembers His children who are suffering.... He sheds tears into the Great Sea and His voice is heard from one end of the earth to the other.... Some say He is clapping His hands together. Others say He is moaning...." (see Berachot 49a)

Our sages understood that earthquakes are an expression of pain in Heaven over the pain of Israel. Seemingly, we can ask: what connection is there between what occurs beneath the crust of the earth in Southeast Asia, or anywhere else on earth, and the plight of Israel? How is it possible to connect Israel's plight to the forces of nature, and to the plight of the rest of the nations? In response, Rabbi Yehuda HaLevi teaches us: "Israel amongst the nations is like the heart amongst the organs of the body." (Kuzari II:36) Just as the heart influences the whole body and is influenced by the whole body, so does Israel influence the world and the nations and is influenced, in turn, by what occurs in the world and amongst mankind.

Today, the earthquake and its horrors have to arouse, all of us, whoever we are, to rectify our deeds and character, to be sensitive to the plight and the suffering of those around us, and to assist them.

At the same time, we and all the nations must take stock of how we relate to the People and Land of Israel. After all, Israel is the heart of the nations and the heart of the world. If the heart is damaged, all will suffer. We have to repent in relation to our people and our land. We have to love and to attach ourselves to them.

Through the Jewish People and Eretz Yisrael, G-d's goodness is revealed in the world, and through that, in turn, sorrow and sadness shall end. Then, we will see with our own eyes how "the earth and the fullness thereof belong to G-d, the world and all its inhabitants." (Psalm 24:1

Who Was Jesus?

The Bible gave a warning about a dangerous, false prophet who would arise to test our faith in G-d.

Moshiach been Satan who will come in his OWN name, and they will accept him

 In Deuteronomy 13, G-d describes this false prophet as a member of the Jewish people (v. 2, 7) who would tell true prophecies and would have the power of miracles. 

The Lord God of Deut. is the Same Word which hath created everything Created, Jesus the Christ the Image of the Father.......do not be deceived in their "Replacement Theology gods" 

 

G-d Himself would give this false prophet the power to perform miracles and reveal prophecy, but the false prophet would try to seduce the people away from G-d's Law and towards strange gods unknown to Judaism.

Judaism is strange gods of Plural She-Kinah the male-female gods they worship. See Hoffman's "Judaism's strange gods"

 The purpose would be to test whether we are truly committed to living under the Law, or whether we will be dazzled and fall for the temptation to join a false path to salvation (v. 3-6, 7-8, 11). 

The Lord is Salvation from the Beginning

Ex:15:2: The LORD is my strength and song, and he is become my salvation: he is my God, and I will prepare him an habitation; my father's God, and I will exalt him.

 

In this Biblical passage, G-d repeatedly commands the Jews to kill this false prophet, lest the evil spread and destroy many souls.

Ps:22:16: For dogs have compassed me: the assembly of the wicked have inclosed me: they pierced my hands and my feet.

To be accepted by the people, the false prophet would sometimes pretend to be a righteous Jew who fulfills the Law, but at key moments he would turn against certain details of the Law in order to make the breach (v. 6, 7).

Genesis 15:

1: After these things the word of the LORD came unto Abram in a vision, saying, Fear not, Abram: I am thy shield, and thy exceeding great reward.
2: And Abram said, Lord GOD, what wilt thou give me, seeing I go childless, and the steward of my house is this Eliezer of Damascus?

 This is the reason that verse 1 commands us not to add or subtract any details from the Law, and verse 5 warns us to remain steadfast with all the traditions of the Law.

Mt:5:17: 

Think not that I am come to destroy the law, or the prophets: I am not come to destroy, but to fulfil.

In Deuteronomy 17, this false prophet is also described as someone who would rebel against the authority of the judges of the Jewish people, and who should be put to death for his rebelliousness (v. 8-13, esp. v. 12). Who are the judges? The highest court in Israel was the Sanhedrin, which was established by Moses (Exodus 18:13-26; Numbers 11:16-29), and which lasted more than 15 centuries. 

Mt:3:7: 

But when he saw many of the Pharisees and Sadducees come to his baptism, he said unto them, O generation of vipers, who hath warned you to flee from the wrath to come?

 

The members of the Sanhedrin were the rabbis known as "Pharisees" (Pirushim, "those with the explanation"). G-d gave permanent authority to these judges to interpret the Law and G-d's Word, and it is a commandment to follow their decisions without turning even slightly to the right or the left (Deut. 17:11). But the false prophet would challenge the authority of the Sanhedrin, thus revealing himself to be an evil man.

Mt:23:7: 

And greetings in the markets, and to be called of men, Rabbi, Rabbi.

Mt:23:8:

 But be not ye called Rabbi: for one is your Master, even Christ; and all ye are brethren.

In the book of the prophet Daniel, this false prophet is described as a king (the eleventh horn on a terrible beast) who would wage war against the Jews (the "holy ones"; see Deut. 14:2 on this term) and would change the Law including the calendar and the holidays (Daniel 7:8, 20-25). Elsewhere, this false prophet is described as a king who would disregard the G-d of his fathers, exalting himself as a god and giving honor to this new god-head (Daniel 11:36-39).

The man known today as "Jesus" fulfilled all these prophecies. He became a "king" (over the Christian church) who changed the original Law, doing away with the Hebrew calendar and the Biblical holidays (Rosh Hashanah, Yom Kippur, Sukkos the Festival of Tabernacles, Passover, etc.). He disregarded the one, infinite G-d of the Hebrew Bible in favor of a new "trinity" that included himself.

1Jn:5:7: 

For there are three that bear record in heaven, the Father, the Word, and the Holy Ghost: and these three are one

 And he repeatedly broke the Law by committing terrible sins, while openly challenging the G-d-given authority of the rabbis of the Sanhedrin.

29: My Father, which gave them me, is greater than all; and no man is able to pluck them out of my Father's hand.
30: I and my Father are one.
31: Then the Jews took up stones again to stone him.
32: Jesus answered them, Many good works have I shewed you from my Father; for which of those works do ye stone me?
33: The Jews answered him, saying, For a good work we stone thee not; but for blasphemy; and because that thou, being a man, makest thyself God.
34: Jesus answered them, Is it not written in your law, 

I said, Ye are gods?


35: If he called them gods, unto whom the word of God came, and the scripture cannot be broken;
36: Say ye of him, whom the Father hath sanctified, and sent into the world, Thou blasphemest; because I said, I am the Son of God?
37: If I do not the works of my Father, believe me not.

Naturally, Jesus did sometimes pretend to respect the Law, but whenever he thought he could get away with it, he turned right around and broke that same Law. In Matthew 5:17-19, he declared that he came to fulfill the Law, and in Matthew 23:1-3 he defended the authority of the rabbis. But the rest of the time, he rebelled against the Law thus showing that his occasional words of piety were meant only to hide his evil agenda. The following sins of Jesus are recorded in the "New Testament":

Jn:8:24: 

I said therefore unto you, that ye shall die in your sins: for if ye believe not that I am he, ye shall die in your sins.

1) Jesus repudiated the laws of kosher food (Mark 7:18-19). [Compare this to the prophet Daniel's strict adherence to kashrus, in Daniel chapter 1.]

2) He repudiated the laws of honoring one's parents, and called on his followers to hate their parents; he also dishonored his own mother (Matthew 10:34-36; Matthew 12:46-50; Luke 14:26).

3) He violated the Sabbath by picking grain, and incited his disciples to do the same (Matthew 12:1-8; Mark 2:23-26).

4) He again violated the Sabbath by healing a man's arm, which was not a matter of saving a life, and he openly defied the rabbis in his total repudiation of the Sabbath (Matthew 12:9-13; Mark 3:1-5). [Compare this to G-d's view of violating the Sabbath, in Numbers 15:32-36, Nehemiah 10:30-32, and dozens of other places throughout the Bible.]

Mt:12:5: Or have ye not read in the law, how that on the sabbath days the priests in the temple profane the sabbath, and are blameless?

5) Jesus brazenly defied and disobeyed the rabbis of the Sanhedrin, repudiating their authority (This is recorded in many places throughout the New Testament, but look especially at Matthew 23:13-39 and John 8:44-45).

But woe unto you, scribes and Pharisees, hypocrites! for ye shut up the kingdom of heaven against men: for ye neither go in yourselves, neither suffer ye them that are entering to go in.

 

The Talmud (Babylonian edition) records other sins of "Jesus the Nazarene":

1) He and his disciples practiced sorcery and black magic, led Jews astray into idolatry, and were sponsored by foreign, gentile powers for the purpose of subverting Jewish worship (Sanhedrin 43a).

2) He was sexually immoral, worshipped statues of stone (a brick is mentioned), was cut off from the Jewish people for his wickedness, and refused to repent (Sanhedrin 107b; Sotah 47a).

3) He learned witchcraft in Egypt and, to perform miracles, used procedures that involved cutting his flesh which is also explicitly banned in the Bible (Shabbos 104b).

The false, rebellious message of Jesus has been thoroughly rejected by the vast majority of the Jewish people, as G-d commanded.

Unfortunately, however, this same message has brought a terrible darkness upon the world; today, over 1.5 billion gentiles believe in Jesus. These lost souls mistakenly think they have found salvation in Jesus; tragically, they are in for a rude awakening. Truth and eternal life are found directly from G-d, through performing His Law. Any "mediator" only separates man from G-d:

1) "G-d is not a man, who can lie, nor the son of man, who relents... He has not beheld iniquity in Jacob, nor has He seen perverseness in Israel" (Numbers 23:19).

2) Speaking prophetically of the Christian church, Moses declared, "For their 'rock' is not like our Rock. Where is their god, in whom they trusted?" (Deut. 32:31, 37).

For had ye believed Moses, ye would have believed me: for he wrote of me.

3) "'See now that I, only I, am He, and there is no god with Me. I kill, and I bring to life; I wound, and I heal, and there is none who can rescue from My Hand.' Sing songs of joy, gentiles, with His people, for He will avenge the blood of His servants, and will take vengeance on His enemies, and will forgive His land and His people" (Deut. 32:39, 43).

Jn:8:24: I said therefore unto you, that ye shall die in your sins: for if ye believe not that I am he, ye shall die in your sins.

Jn:8:28: Then said Jesus unto them, When ye have lifted up the Son of man, then shall ye know that I am he, and that I do nothing of myself; but as my Father hath taught me, I speak these things.

Jn:9:9: Some said, This is he: others said, He is like him: but he said, I am he.

4) "I, only I am Hashem (the L-rd), and besides Me there is no savior" (Isaiah 43:11).

7: Of the increase of his government and peace there shall be no end, upon the throne of David, and upon his kingdom, to order it, and to establish it with judgment and with justice from henceforth even for ever. The zeal of the LORD of hosts will perform this.

What is the true key to salvation? Those who return to the Law (the Seven Commandments for the Children of Noah, according to the eternal covenant made with Noah in Genesis 9) and who assist the Jewish people (Isaiah 60, 61, 66) will be saved and will participate in the miracles and revelations, including worshipping in the Third Temple, under the kingship of the Messiah.

Switzerland's small Jewish community is in uproar over a government report which describes some Jewish youth as armed radicals and talks of the possibility of "violent extremism" by some Swiss Jews.
 
The country's main Jewish organisation is calling for the contentious passages to be cut from the report and for a meeting with the justice minister, a Swiss nationalist, to demand an explanation for the allegations which it denounces as "false," "outrageous," and "perhaps made in bad will".

The deputy head of the domestic intelligence service has had to apologise (For fear of the jews) for its report and order the deletion of references to some Jewish students in Geneva as armed radicals.
 
But Swiss Jewish leaders remain angry that the amended version of the annual report from the Swiss domestic intelligence service, on the risks of political violence and extremism, retains claims that "violent anti-semitic acts could lead to vigilantism and violent Jewish extremism".
 
The original report released last August said: "Jewish political extremism manifests itself in the conduct of associations fighting for the Zionist cause." It singled out an association of Jewish students in Geneva.
 
"Some of the young members are armed. They belong to a security agency and attend every event in the Jewish community. At the moment there is no evidence of links between these groups and the Kahane-Hai terror group."
 
 
These claims stoked fury among the small Jewish community of around 18,000 in a country of almost 8 million. The passage was deleted and an apology made.
 
Alfred Donath, president of the Federation of Swiss Jewish Communities, is demanding, however, that all references to alleged Jewish extremism in Switzerland be dropped.
 
"Jews in Switzerland are outraged," he told the Zurich newspaper Neue Zuercher Zeitung. "There is no Jewish extremism here ... the accusation of extremism is utterly false." Mr Donath said synagogues and other Jewish institutions had private armed security guards posted around them "here and there, because regrettably the state is unable to guarantee our safety ... it is completely legal".
 
Mr Donath and other community leaders are expecting to meet the justice minister, Christoph Blocher, in a fortnight to demand an explanation and to urge him to have the report revised for the second time.
 
Mr Blocher is the leader of the nationalist Swiss People's party, which campaigns on an anti-immigration platform.
 
While Mr Donath said there had been no let-up in anti-semitism in Switzerland in recent times, he was sanguine about the dangers of anti-semitism from Switzerland's Muslim minority. "Of course, it wasn't Islam that caused the Shoah [Holocaust]," he noted.
 
Relations between the Swiss majority and its Jewish community have seldom been easy, but came under greater strain as a result of the dripfeed of revelations in the 1990s over how the Swiss establishment profited from handling and processing the plunder of Jews in Nazi Germany and the Swiss reluctance to own up to the misdeeds.

SHIUR #5: Appointing A King

Having analyzed in previous shiurim (teaching) some of the different aspects inherent in monarchy, the time has come to direct our attention to individual components of the halakhic system of government. (Law) 

Which of the various possibilities for selecting a king does the Torah endorse? Actually, the formulation of the Torah itself is ambiguous. On the one hand, the narrative states that the people will set a king upon themselves (Devarim 17:14 - "Ve-amarta asima alai melekh"). On the other hand, the king is described by the Torah, in the very next verse, as being chosen by God.

The Ramban, who points out the discrepancy between the two verses, quotes the opinion of "the commentators" (da'at ha-mefarshim) who explain that the choice of the king is in God's hands, made known to us by means of the urim ve-tumim or the prophet. The first verse, which describes the people as choosing their king should be understood to mean that they shall coronate the person chosen by God. The Ramban himself, however, believes that it is the people who appoint the monarch, offering various other suggestions to understand the phrase that the king will be God's choice.

 

A third approach is adopted by the Rambam who combines the two elements, ruling that both the Sanhedrin (High Court) and a navi (prophet) are required.

Actually, the Rambam is fusing together two Tannaitic sources. The Tosefta (Sanhedrin 3:4) states that the Sanhedrin is required to appoint a king, while the Sifri explains that the prophet (False Prophet)  determines God's (plural gods of judaism, she-Kinah) choice. 

Rather than assuming that the two sources disagree, along the lines of the Ramban and "the commentators," the Rambam posits a system which accepts both elements as necessary to appoint a monarch. What is the relationship between the functions? Obviously, if the navi (False Prophet) selects a person as being worthy of the position, the Sanhedrin would not be able to contradict his choice, for they cannot dare claim that their knowledge or information is better than his.

"For man can see the eyes, but God sees into the heart." Therefore, we must understand the Rambam as requiring human participation in order to establish an additional source of authority. Though the prophet is the ultimate search committee, whose ruling is final, the Sanhedrin must be involved as representing the people. 

Their acceptance and appointment of the king establishes the monarch as deriving his authority from the people's election. 

Rv:14:9: And the third angel followed them, saying with a loud voice, If any man worship the beast and his image, and receive his mark in his forehead, or in his hand,

Rv:14:11: And the smoke of their torment ascendeth up for ever and ever: and they have no rest day nor night, who worship the beast and his image, and whosoever receiveth the mark of his name.

The Sanhedrin do not function here in their judicial but rather in their representative capacity. By involving the Sanhedrin in addition to the prophet, the Rambam roots the monarchical powers in the will and acceptance of the nation.

 The same point is explicit in a gemara in Berakhot (55a), though in somewhat of an aggadic context.

 

Even though the Almighty has chosen Betzalel, He requests that the people also participate in the selection. Moshe's reaction is that since God Himself has made the decision, what need is there for any additional input? After all, the proper choice has certainly been made. The Almighty, though, responds that the participation of the people is necessary, not in order to select the best candidate, but in order to provide him with the necessary mandate for his authority.

[The idea of the Sanhedrin functioning as the representative body of Am Yisrael, at least in the Rambam's doctrine, is well established and has been advanced by various Acharonim, basing themselves upon the Rambam's formulations in Hilkhot Terumot 1:2 and Hilkhot Melakhim 5:2. See Rav Soloveitchik's article on kiddush ha-chodesh in Kovetz Chidushei Torah and Rav Goren's discussion in the opening essay of his sefer Meishiv Milchama, amongst others. Having concluded that the Rambam requires a mandate from the people and therefore rules that the Sanhedrin must be involved in the selection, we must now look into the role of the prophet. Is he serving only as a search committee, better equipped than mere mortals to identify the proper candidate, but not invested with any special authority, or does he also serve as the representative of Divine authority? In other words, is the source of monarchical power rooted only in a human source of authority or is a Heavenly source required as well? The implications of this for our current situation are obvious. If the only necessary source of authority is the decision of the people, then it is available nowadays, no less than in yesteryear, and open to democratic as well as monarchical heads of government. If, however, Divine authority is also required, then we can only grant legitimacy by means of a prophet or the urim ve-tumim. (Other possible sources of authority for democratic functions will be discussed in future installments, b"n.

The halakhic expression of this query is the issue whether a navi is required only le-khatchila or also be-di'eved. If we support the former position that the navi is no more than a search committee, then his involvement is not crucial. If he can assist in the selection process - thank God; if not, then Beth Din (the court) will apply their own judgment. 

However, the latter position maintains that God must grant His authority, and therefore the navi is indispensable. The Keren Ora, in his commentary on Horayot (11b) seems to suggest that this issue is a machloket (dispute) between the Talmud Bavli and the Yerushalmi.

The Bavli is of the opinion that any leader accepted by the people is considered a king, while the Yerushalmi, which states that all Israelite kings after Yehu were thieves (since they were not appointed by a prophet), insists upon the authority of the navi alone to grant the mantle of monarchy. He also quotes a Tosafot (Sanhedrin 20b) that requires election by God in order to exercise royal authority, since Divine authority alone can grant one man power over his fellow man. In contrast to this Tosafot, the Rambam in his commentary on the Mishna (Keritut 1:1) raises various scenarios regarding the accession of a prospective king, including popular acclaim, use of force, appointment by a navi, the Sanhedrin or Kohen Gadol, all of which are recognized as granting him royal authority.

Two other well-known sources who address this issue are the Radvaz (Melakhim 3:8), who opines that a king may be chosen either by a prophet or by the people, and Rav Kook, who ponders this issue in a teshuva (Mishpat Kohen 144:15) and tends to accept the first option, that a navi is dispensable, thus paving his way for legitimizing the Hasmonean kingdom.

 

Thus, the question of the necessity of Divine involvement in the appointment of a king is the subject of a (possible) machloket between the Bavli and the Yerushalmi and between Rambam and Tosafot, and is also the subject of further discussion in Acharonim.

 

Having presented the above mentioned opinions, we cannot yet conclude this segment without connecting them to the issues and concepts dealt with in previous shiurim. Throughout all of the above discussion, we did not dis between different functions of royalty. However, as we explained in previous shiurim, it is obvious that not all halakhot (law) relating to a melekh (Moshiach) can be lumped together without analyzing their essential nature. Therefore, we must now proceed to review our conclusions in light of this. As a starting point, we may take a remark of Rav Kook's in the closing lines of the responsum cited above. Having been questioned as to the right of the Hasmoneans to wage war (a royal prerogative) and concluding that they were legitimate rulers since appointment by a navi is dispensable, he adds the following:

 

The truth of his remarks rings loud and clear. As long as we are concerned with the public weal - what we defined as issues of malkhut (government) rather than personal status - it is eminently logical that the people have the ability to grant the authority and prerequisites of power to a ruler (or, in the absence of a monarchy, to any governing administration set up by the people). To the extent that a navi is needed, it is only for matters pertaining to the king's personal status. Conversely, if we accept the claim that the Davidic kingdom confers a personal sacral status, that clearly can be authorized by Divine authorization alone.

 

Thus, the sources cited above must be analyzed as to which element of monarchy they are dealing with. Since both the Bavli and Yerushalmi are discussing the issue of korban nasi (leader's sacrifice), they are obviously disagreeing; however, it is not necessarily a machloket regarding the legitimacy of the governing authority, but rather a narrower question of whether the korban is a function of personal status or abuse of power. The Radvaz makes his comment regarding the halakha of mored be-malkhut; Tosafot discuss mishpat ha-melekh (royal privileges); the Rambam deals with the halakha of anointing a king after a disputed succession; and Rav Kook is confronted by the issue of declaring war. Regarding each, a separate analysis must be made. At the moment, we will not undertake this task; however, we must point out that the issue at stake may be the understanding of each particular function and its relationship to the varying royal elements, rather than a sweeping machloket as to the need for a navi to legitimize royal power and person.

In conclusion, it is worthwhile to point out that the Ramban also claims, basing himself on the phrase, "Ve-amarta asima alai melekh," that the people's request of a king is itself part of the mitzva, a requirement which would indicate that the source of authority is rooted in the people, who must express their willingness to establish a human king over themselves.

A Note from the Author: For the eighty-one months that we have been publishing I can safely say that nothing we have ever published is as urgent or as clear as the warning we publish in this article.

But when the run on the dollar begins, OPEC will inevitably at some point switch its pricing to the Euro, which the entire world is wrangling - much to Europe's chagrin - into not only a safe-haven currency, but a profitable one. The next house is being built before the old one is abandoned. When the run on the dollar begins, it will be as if the rest of the world declared war on the United States of America by launching a missile, dropping a bomb, or landing an army at Bethany Beach, Delaware. That this will lead ultimately to widespread global warfare seems certain. This is exactly the way the administration is setting it up to appear to the American people. Think of 9/11 times fifty.

The rest of the world is merely defending itself with non-violent means - for the moment. But it will be portrayed as an attack upon the US. "Why?" George Bush will ask, rhetorically. "They hate us because of our freedom."

And, barring a miracle, the end results will be exactly the same as from a physical attack: devastation so complete and unthinkable - magnified by the brutal impacts of Peak Oil - that only a few will even try to prepare for it. That is sad because preparation will make all the difference (barring luck or divine intervention) in who survives and to what extent they remain intact and functioning afterwards.

John Lennon wrote, "Life is what happens while you're busy making other plans."

Since the US general election, while many in the US and around the world have been recovering from a gut shot which left them gasping for breath, an "asymmetrical" mobilization for global conflict has begun at warp speed. While many of the world's citizens and nations were unprepared for a second-straight US presidential election theft, it is obvious that many of the world's more powerful governments were anticipating and preparing for it for some time. They had their track shoes on and were in the starting blocks on November 3rd. There is no other explanation for the pace at which economic, political, military and energy events have moved around the world in the three weeks since November 2nd. The end of the world "as we know it" is very close. There may be nothing that can be done to prevent it and only little that will soften its impact. This places even greater importance on what FTW has been advocating for many years: personal and community preparedness.

This article constitutes FTW's third-ever economic warning to its subscribers. The first, published on September 9, 2001 was followed two days later by the "attacks" on the World Trade Center and Pentagon. The second was on July 8, 2002 just before a precipitous drop in the Dow of more than 1400 points and the wiping out of more than a trillion dollars of shareholder equity, especially from pension funds.

One key to grasping the interrelatedness of these developments is to understand that dramatic economic collapse, especially in the case of a super power or an Empire, has historically created a power vacuum which has resulted in war. If, as von Clausewitz said, "war is a continuation of politics by other means," then we must also admit that politics is a continuation of economics; and economics is a continuation of energy. All economics (at least in this world) is founded upon energy, whether it is hydrocarbon energy or physical labor (food calories). There are 10 calories of hydrocarbon energy in every calorie of food consumed.

Energy is the ability to do work; it is, in effect, the ability to survive. Energy is economics. Now, economic warfare several orders of magnitude above that which has occurred since 9/11 is underway. As much of the world hoped it would soon be dealing with a Kerry presidency that might have provided a partner still worth working with, it refrained from making economic moves that might permanently damage the US.

There was no point in destroying the US economy until it became clear that the election was rigged and the neocons had been moving ahead with a hostile agenda all along. For the world, November 2nd represented yet another Rubicon: there is no longer any hope of "peaceful coexistence" with the American Empire. Ultimately this conflict must become a physical one.

This apparently was what the neocons wanted to make clear as well. This is what they intend (it was what they meant by the phrase "nothing will stop us," repeated four times in Bush's RNC speech). They also wanted it understood that the Empire would willingly sacrifice its own people in a test of wills much as the Soviet Union did in World War II. As such, only the global elites, defined by money and power rather than nationality, stand to benefit in the short term. Indeed, given the nuclear threat involved, it is now debatable whether there will even be much of a long term (twenty years hence) to prognosticate about.

An all-out run on the dollar is imminent and from the moment that begins we will be living in a whole new ruthless and unforgiving world. The best way to weaken the American military before fighting it is to eliminate as much of its funding as possible.

If my warning seems hyperbolic to you, then consider just one statement made by someone whose job it is to avoid hyperbole.

On November 23rd the Boston Herald reported on a shocking statement made by Stephen Roach, the chief economist for investment banking giant Morgan Stanley. "Roach met selected groups of fund managers downtown last week, including a group at Fidelity. His prediction: America has no better than a 10 per cent chance of avoiding economic "Armageddon."

Press were not allowed into the meetings. But the Herald has obtained a copy of Roach's presentation. A stunned source who was at one meeting said, "it struck me how extreme he was - much more, it seemed to me, than in public." Roach sees a 30 percent chance of a slump soon and a 60 per cent chance that "we'll muddle through for a while and delay the eventual Armageddon."

The core of Roach's analysis is the simple fact that, in order to keep the US economy afloat and maintain even moderate faith in the dollar, it must secure $2.8 billion dollars a day in foreign direct investment (FDI), largely through the purchase of Treasury notes to service its bubble economy. Other sources have placed the required FDI at $4 billion per day.

What is the sense of this as the Bush administration raised the US debt ceiling by 800 billion on November 19th and continues to pull the rug out from under the dollar while at the same time cutting taxes and increasing spending? There were warning signs that these wellpublicized moves were dangerous for Americans and their wallets more than two months ago when, on September 9th, the routine daily T-Bill auction at the US Treasury opened and no one showed up to buy. Marshall Auerback - one of FTW's favorite economic analysts - writing for Prudent Bear (www.prudentbear.com) on Nov 16th reported:

Suppose they had a bond auction and everybody stayed home? We had a variant on that theme a few months ago. During a routine sale of U.S. Treasury bonds in early September, one of the essential pillars holding up the economy suddenly disappeared. Foreigners, who had hitherto been regularly buying nearly half of all debt issued by the U.S. government stayed home on September 9th.

"Thoughts of panic flickered out there," said Sadakichi Robbins, head of global fixed-income trading at Bank Julius Baer. To be sure, the foreigners returned in force at the next Treasury auction, and Sept. 9 was quickly dismissed as an aberration.

But the episode demonstrated something we have repeated on these pages ad nauseum: the extent to which the US remains dependent on the kindness of strangers in terms of sustaining its very way of life.(I wonder who these strangers could be?... We have posited the notion that a buyers' strike, a foreign creditors' revulsion, could arrive as a sudden thunderclap of financial crisis--spiking interest rates, swooning stock market and crashing home prices, a scenario which will not seem so absurd if we have a few more days like September 9th.

In the midst of these developments - common knowledge in Wall Street's boardrooms - Reuters reported on November 15th that bonuses for Wall Street executives were set to jump by 10% to 15% this year. Almost simultaneously, the New York Times reported on November 21st, "Soaring Interest Compounds Credit Card Pain for Millions." The latter story revealed that in recent months credit card companies have unilaterally increased (in some cases doubled) interest rates on credit card debt without notice. The net result has been drastic increases in minimum monthly payments and interest rates that have soared in some states to as high as 28%. What would you do if your monthly minimum on one card went from $460 to $780 dollars?

Most Americans today cannot dig out from that kind of debt and this is a sure indicator that the weight of a major economic meltdown will be placed on the shoulders of consumers instead of corporations - at first. Consumers will never be able to dig out when the economy collapses. As Catherine Austin Fitts points out, lenders have an obligation to exercise diligence to see that borrowers are able to repay loans before making them.

What is happening is that lenders are at one and the same time encouraging people to borrow while systematically undermining - universally - their ability to repay those loans. Americans are still being encouraged to borrow and spend when they should be being warned to cut back and decrease debt. The main reason is because soon - in the blink of an eye - the world is going to stop underwriting this binge-bubble economy and there will be no safety net for those weighed down by debt. Why? It's called a wealth transfer. It happened in the Great Depression and FTW described it thoroughly in its analysis of the crack cocaine epidemic in South Central LA in the 1980s. The trillions stolen from the US Treasury, looted by stock manipulations and derivative-based investment bubbles, will be available to buy back our devalued assets at pennies on the dollar after the collapse. This is the sickness of America's (and the world's) governing economic paradigm. This is also a sickness that is rushing the world toward the kind of war that spreads beyond human control very rapidly: World War I on steroids and amphetamines.

PRELUDE TO WAR - Dumping the Dollar

What has happened since November 2nd is that the entire world has been telegraphing a clear intent to stop providing America with its FDI subsidy. What has also been telegraphed is the administration's encouragement of this. The dollar will have to crash. But when? How far?

The rest of the world has realized that military confrontation with the US is not practical. Yes, it is true that the US military cannot wage a global war on many fronts. It is having a hard enough time holding its own in Iraq and Afghanistan. There will be no invasion of Iran. China has just signed a $200 billion investment agreement with its government (Asia Times, Nov. 6th). India, Germany and Russia are signing oil and gas deals with Iran hand over fist. This is global insurance for Iran, which plans to open an oil futures trading bourse priced in Euros in 2005.

The US (Britain and Israel) cannot afford to attack hundreds of billions of dollars in Chinese, Russian, Indian, German and other foreign investments. It will not. There are as yet no volunteers from among the other nations to suffer the carnage necessary to break the US military's back in an open firefight. But there are nonviolent ways to fight the Empire which are in fact precursors to military confrontations. At some point the Empire will resort to what it knows, maybe in the Ukraine, maybe in Africa, maybe in Latin America. At some point after that, unless something is done, the safeties will come off nuclear and biological weapons. The unthinkable will become a rational option.

All of that may take less than a year. In the meantime the trick for the rest of the world is how to get out of the dollar before it plummets and thus protect foreign currency holdings.

Catch 22? Maybe not. Many countries are now signaling that they are willing to take a little shot in order to give the US a very big one. That's what November 2nd told Wall Street, the Treasury and the Fed. And - according to a November 29th AP story reprinted in Forbes - China's Central Bank has now moved in to try and manage the dollar's decline by buying and selling them through its four largest banks. The likely intent is to allow all the other nations aligning with this plan to get out safely with minimal losses. Only China has currency reserves (approximately US $175 billion) and an economy big enough (even as Peak Oil is just beginning to hit home) to underwrite the switch and make it palatable to those taking the risk. It appears that since November 2nd the rest of the world feels it has much less to lose. They are correct. The oil and gas supplied by Iran are essential to the survival of many countries.

But China is also facing increasingly frequent blackouts due to energy shortages. If it is going to move on the dollar it must move before its economy slows and the US, Koreans, Europe, Japan, Canada, and the rest of the industrialized world start to shut down their factories there and withdraw their investments. In short, China must strike at the dollar while China stands a chance of winning. It will never have a better opportunity than right now.

IN the preceding issue of this journal, the article, "Signs Amongst the Jews," made reference to "The Revision of the Trial of Jesus," quoting Dr. Max I. Reich, one of the leaders of the Hebrew Christian Alliance of America. Refreshing our minds in this connection, Dr. Reich went on to say that the "condemnation of Jesus was the act of. the Sanhedrin, the official representative of the Jewish nation," and that "there is considerable talk just now of reviving that institution." Furthermore; "one of its first acts will have to be the re-examination of the evidence on which the terrible verdict was made in the days of Anna and Caiaphas. Jewish Christians particularly will have to insist on this being done."

It is of more than usual interest now to learn that there is already a move under way by some prominent orthodox Jews, having as their object "the organization of a Jewish society for the promotion of the Divine Mission of Israel." And one of the principal purposes of this society will be the "assembly of our Great Sanhedrin at the Holy City of Jerusalem, to review the jurisdiction, judgments and decrees of the Sanhedrin acting at Jerusalem during the power and domination of Rome, and especially to consider and review the life and trial of Jesus of Nazareth."

A letter recently received from one of the brethren in Denver, Colorado, calls our attention to the matter as follows:

"Just a note to tell you that for the past two years I have been in personal contact with Mr. Solomon Shwayder, of this city, who is a prominent orthodox Jew. This freedom and security accorded to the Jewish people of this present generation involves an obligation to give a Jewish answer to the blood accusations hurled at the Jewish people. Since the destruction of Jerusalem by the Roman Power, and in every generation thereafter, and for nearly two thousand years, since the forcible dispersion of the Jewish people among the Gentile nations, violent blood accusations have been hurled against the Jewish people, holding them all responsible and guilty, our ancestors and their descendents alike, of the trial and crucifixion of Jesus of Nazareth.

And for nearly two thousand years, the children of Israel, in all generations, have been compelled to stand mute and silent to all these violent accusations, because the little bands of Jews, scattered broadcast throughout the Christian world, dared not to speak and give their answer, and defend themselves in the presence of the vast numbers of hostile Gentile peoples that surrounded them.

And now, for the first time since the trial and crucifixion of Jesus of Nazareth, the present generation of Jews has been granted the right, privilege and opportunity to give an organized and authoritative answer to the violent accusations that have been continuously hurled at us for these two thousand years. The Jewish people now have the liberty, freedom and security to give the world their solemn answer at the Holy City of Jerusalem, where the tremendous events took place, and which is the only proper place in all the world, where the Jews could give their true and proper answer.

Let us therefore initiate a movement, which shall have for its main purpose the review of the life and trial of Jesus of Nazareth. To that end, a Court of Review, made up of the Great Sanhedrin of seventy-one members, comprising the leading Rabbis, Jewish scholars, and laymen of the world, should in due time, be assembled at Jerusalem to review the jurisdiction, judgments and decrees of the Sanhedrin acting at Jerusalem during the power and domination of ancient Rome, and which was the Sanhedrin that condemned Jesus.

While the trial and crucifixion of Jesus occurred nearly two thousand years ago, the matter has always remained to every generation thereafter, a burning issue for all Jews, down to this very day. Two thousand years is a very long time in the sight of man, but no statute of limitations is applicable, where men are accused of violating the laws of God, especially when a thousand years in the sight of God is but a day.

We should therefore cheerfully and manfully face the issues raised by the blood accusations hurled at the heads of our ancestors and ourselves, and carefully review and consider and give a solemn Jewish answer to the life, trial and crucifixion of Jesus of Nazareth, that marvelous Jewish son who sprang from the loins of Israel, and who is the most esteemed and venerated of all men in the sight of hundreds of millions of Christian people throughout the nations of the world. Let us also be reminded of the fact that in the very midst of the bitterest Christian persecutions of the Jews, many of our greatest Rabbis and scholars have praised the personality of Jesus, and have certified that the propagation of Christianity was ordained through the providence of God, as a means of bringing our Holy Scriptures and the knowledge of God to the Gentile nations of the world.

Let the present generation of Jews now grasp this glorious opportunity to redeem the good name of our ancestors and of ourselves, and for the sake of our. children, and of the good name of the generations of Jews who are to follow us.

Let us therefore now take the initial steps to organize and establish a Court of Review, and assemble the Great Sanhedrin at the Holy City of Jerusalem, to review the life and trial of Jesus of Nazareth. Let Christian scholars of every denomination be also invited to appear and present evidence and argument. Let us diligently and honestly search for the facts, and earnestly seek to discover the evidence, and thereupon boldly announce the truth. And if our ancestors were guilty of any crime in this matter, or violated any law or commandment of God, let the Great Sanhedrin fearlessly acknowledge our guilt, and crave Divine pardon. Let a true and righteous judgment be rendered, regardless of the consequences.

Following is the letter of invitation which accompanied Mr. Shwayder's Explanatory Letter

IN THE NAME OF GOD, AMEN

You are invited to attend and participate in a meeting at my home, 663 Fillmore Street, Denver, Colorado, on the Sunday of the next Passover, 5689, C. E. April 28, 1929, at 8 p. m., which meeting is hereby called for the purpose of discussing and deliberating upon the organization of a Jewish Society for the promotion of the Divine Mission of Israel.

In furtherance of that purpose, this society will in due time select a representative who shall proceed to Jerusalem to confer with our brethren there, who will thereupon issue a Call from Jerusalem to all Israel throughout the Nations of the World, for the assembly of our Great Sanhedrin at the Holy City of Jerusalem, to review the jurisdiction, judgments and decrees of the Sanhedrin acting at Jerusalem during the power and domination of Rome, and especially to consider and review the life and trial of Jesus of Nazareth.

And the Great Sanhedrin, after the impartial reception of all evidence appertaining thereto, and after the consideration of the historical circumstances surrounding these events, and after hearing every argument that may be presented by all competent Christian as well as Jewish scholars, learned upon the subject, the Great Sanhedrin shall, after due and careful deliberation, render a true decision and righteous judgment therein.

The Great Sanhedrin, furthermore, shall review the decisions and judgments of our Rabbis, issued in the centuries following the destruction of Jerusalem by the Roman power, (By the Father)  which decisions and judgments, interpreting Divine Law, have vitally preserved the spiritual life of the Jewish people in all generations living in the past twenty centuries, but which decisions and judgments of our Rabbis may now need revision, in order better to provide for the future spiritual welfare of our people.

All of which acts, decisions and judgments, the Great Sanhedrin shall carefully review and consider in the light of the Holy Scriptures (Talmud bavli) and in the light of the recent tremendous events arising from the World War, which have profoundly affected the life of all nations, and which have deeply altered the vital currents of World history, And after due and careful deliberation upon all these matters, the Great Sanhedrin shall fearlessly render true decisions and righteous judgments therein, and thereby promote the spiritual welfare of all Israel throughout the world.

May the Lord our God guide and bless all acts and deliberations serving to promote these matters to a good and righteous conclusion, Amen.

UTJ Saves Sharon Government

The decision was made by Torah Sage Rabbi Yosef Shalom Elyashiv following months of deliberations and numerous visits and consultations with fellow rabbis.

UTJ MK Avraham Ravitz announced the decision, saying his party would join for a trial period of three months – after which Rabbi Elyashiv would gauge the government’s willingness to keep the promises it made to the party. MK Yisrael Eichler said that amongst the guarantees made to the party were promises not to interfere with the hareidi school system, allowing it to remain independent. “In three months it will be clear whether the government stands by its word,” he said.

Small hareidi schools were due to be closed, and many placed under government supervision during the implementation of the recommendations put forth by the Dovrat Commission.

Ravitz told Channel One television that Rabbi Elyashiv, "Like every Torah scholar, took into account a wide variety of issues" in making the decision to allow the UTJ to join the government. The decision comes despite an extensive campaign to let the government fall. Internal opposition included UTJ members and several of the rabbis on the party’s Council of Torah Sages.

The Admor of Sadigura, one of 15 rabbis on the Council of Torah Sages, sent a letter to his colleagues, asking them to vote "nay." He wrote that joining the government at this stage would support the destruction of the Jewish settlement enterprise in Gush Katif. He said that monetary matters must be separated from the matter of the "destruction of communities, yeshivot and synagogues in Judea, Samaria and Gaza."

With UTJ’s five Knesset seats, in addition to Likud's 40 and Labor's 21, the Sharon government will once again have a Knesset majority - though 13 Likud members have already declared their intention to vote against PM Sharon’s disengagement plan.

Some 300 demonstrators – mostly hareidi yeshiva students – gathered outside the home of UTJ party chairman MK Yaakov Litzman Tuesday evening to protest his willingness to join the Sharon government – enabling it to push ahead with PM Sharon’s plan to expel 8,500 Jews from their homes in Gaza and northern Samaria.

Rabbi Elyashiv limited his consent, not allowing UTJ MKs to take any appointed positions. Two parties make up the UTJ faction, though. The Degel HaTorah faction's MKs will not accept positions, but MK Litzman, from the Agudat HaTorah faction, is slated to become Chairman of the Knesset Finance Committee. Degel HaTorah MK Avraham Ravitz will become Deputy-Minister of the Welfare Ministry once UTJ officially joins the coalition.

The coalition agreement is scheduled to be signed Thursday evening.

NRP chairman Effie Eitam said that the UTJ's decision is a humiliation for the entire hareidi-religious public. "The Prime Minister intends on destroying everything holy to the religious public and is simply using UTJ temporarily to push his withdrawal plan through," Eitam said. "He will toss them aside after three months when will have already used them to push through the destruction of the synagogues, schools, cemeteries and kollels (full-time Torah study centers) of Gush Katif and the northern Shomron.

Yudel Is the Recognized Moshiach

  • Still today, several years after the Rebbe ceased to reside in Crown Heights, Lubavitcher Chasidim continue to refer to the shul at 770 Eastern Parkway, Yudel's shul, as "beis rabbeinu she-be-bovel," recognizing that Yudel is "rabbeinu" — "our master."

     

 
 
  • In kovetz Moshiach u'Ge'ula vol 2, published by Yagdil Torah in 5757, Rabbi Yoel Kahn writes that the Rebbe was very particular in choosing his words and that whatever Chasidim understand them to mean was certainly intended by the Rebbe. Therefore, since the Rebbe's words can be understood as proof that Yudel is Moshiach, Yoel Kahn concludes that it must be true that Yudel is certainly Moshiach.

     

  • Before his death, Rav Aharon Soloveitchik, the rosh yeshiva of Yeshivas Brisk, Chicago, wrote an emphatic letter stating that there was no foundation in Torah to conclude that Yudel is not Moshiach. Here we have a definitive ruling from a prominent talmid chochom that it is incumbent on every Jew to recognize Yudel as Moshiach.

     

 
 

  • On 3 Tishrei, 5761,(2001) in a major "didan notzach" in the case of the Weinstock estate, the honorable Judge Michael Feinberg of the Brooklyn Surrogate Court delivered a ruling officially recognizing Yudel's nesi'us.

     

  • Receipts issued from Machne Israel dated well after gimmel Tammuz continued to read "tachas nesi'us chak admur shlita" ("Under the leadership of our Rebbe may he live and be well") in an open testament to the movement's recognition of Yudel's nesi'us.

     

 
 
  • The walls in Yudel's shul at 770 Eastern Parkway are covered with the slogan "Long Live Our Master King Moshiach For Ever And Ever."

     

  • In 1997 six prominent Lubavitcher authorities signed a psak din making it a requirement for every Jew to accept Yudel as Moshiach. This psak din has now accrued over 150 signatories including Rabbi Adolf Shayevich, one of Russia's two chief Rabbis. In Sefer ha-Sichos 5752, p. 368, the Rebbe mentions this ruling.
