Alberto Gonzales, the White House counsel who advised that the Geneva Conventions and international anti-torture treaties did not apply to terrorist suspects held by the US, was yesterday selected by President George Bush as his new attorney general.

Officials said that if confirmed by the Senate, Mr Gonzales would succeed John Ashcroft, whose resignation from the post was announced on Tuesday. Mr Gonzales, 49, would be the first Hispanic to hold the position.

Mr Gonzales was among several possible replacements widely discussed before the election when it was thought Mr Ashcroft would not serve in a second term. He also wrote a memo in February 2002 in which the Bush administration claimed the right to ignore international treaties prohibiting torture of prisoners. Campaigners said that memo led directly to the sort of abuses that were uncovered at Abu Ghraib in Iraq and which have been alleged at Guantanamo Bay.

The magazine's investigation found Mr Gonzales "repeatedly failed to apprise the governor of crucial issues in the cases at hand: ineffective counsel, conflict of interest, mitigating evidence, even actual evidence of innocence". The magazine said Mr Gonzales appeared to exclude factors such as "mental illness or incompetence, childhood physical or sexual abuse, remorse, rehabilitation or racial discrimination in jury selection".

The replacement of Mr Ashcroft was first of what will likely be several reshuffles in the cabinet over the coming days and weeks. Mr Bush is already looking for a replacement for Commerce Secretary Donald Evans, who announced his resignation on Tuesday.

 

Yesterday Mr Bush was due to meet the Secretary of State Colin Powell, about whose future there has been intense speculation. It was generally considered Mr Powell would not serve in a second term but there has been a flurry of reports suggesting he might.

 

Senator John Kerry, the former Democratic presidential candidate, yesterday offered a statement in which he called Mr Ashcroft "one of the most divisive faces in this administration". He said: "With the end of the era of John Ashcroft, the President now has an opportunity to heal those divisions and make good on his promise of renewed bipartisan co-operation."

Republican Senator Pete Domenicic, chairman of the Senate Energy Committee, said: "With oil at $50 a barrel, and likely to stay there for months, the market mandates congressional action. We can develop ANWR without harming the environment or the wildlife. Now is the time to do that."

Fallujah Situation
'Disastrous', Charity Says

Civilians trapped in Fallujah face a humanitarian disaster unless Iraqi and American authorities allow food, water and medicine into the besieged city, aid agencies warned last night.

 

Fardous al-Ubaidi, head of the Iraqi Red Crescent Society, said her organisation had asked permission from the Iraqi government to deliver aid supplies to people in the city but the request was turned down.

 

"There is no water, no food, no medicine, no electricity and no fuel and when we asked for permission, we were only allowed to approach the Fallujah outskirts but had no access to Fallujah itself," Ms al-Ubaidi said. A convoy of three ambulances and one truck carrying food accompanied by 15 volunteers will make the first attempt to enter the city today, she added.

 

Ahmed al-Rawi, of the Red Cross, said: "Movement is impossible inside the city. The residents fear the snipers and therefore the wounded find no help and bleed to death." On the eve of the assault, the interim Prime Minister, Ayad Allawi, imposed a 24-hour curfew on Fallujah and ordered roads in the area closed.

Meanwhile, British soldiers from the Black Watch were involved in a series of running battles with insurgents yesterday after going to the support of American forces in the city.

 

The fighting began after US Marines in the outer ring of the assault force asked the Black Watch to intercept militants retreating after a heavy exchange of fire. British Warrior armoured cars answering the call came under sustained attack from automatic rifle fire and rocket-propelled grenades.

 

The militants withdrew after the Warriors fired back with their cannons and machine-guns and British helicopters gave chase. A car was eventually halted and the occupants fled after booby-trapping a cache of mortars, rocket-propelled grenades and explosives. Following further gun battles a second car was seized in a village on the banks of the Euphrates. It contained devices used for suicide bombings including detonators, circuit boards and explosives.

 

Two men were arrested at the village after being pointed out by a cleric, but two other cars driven by insurgents escaped.

 

Major Alastair Aitken, of the Black Watch, said: "This was a difficult operation at an increasingly busy time, and it was a successful outcome. But we have to be ready for more situations like this."

 

An audiotape purportedly by Abu Musab al-Zarqawi, the al-Qaida-linked terror suspect, urged on his fighters in Fallujah and said victory was near. The link to the tape surfaced yesterday on an internet site known as a clearinghouse for militant Muslim comment, although its authenticity has yet to be confirmed.

 

"As for you heroes of Islam in Fallujah, praise to your Jihad, praise to your nation, praise to your religion. [Have] one hour's patience, and then you will be see the consequences," said the speaker after identifying himself as Zarqawi.

Inside Fallujah, intense fighting erupted in the north-west of the city, just as US commanders were declaring that they had trapped resistance fighters in the southern end and were about to launch a final assault to take control.

 

The American forces insisted that attacks by rebels on a narrow strip of south Fallujah were isolated. Roy Meek, a Marines spokesman, said: "They can't go north because that's where we are. They can't go west because of the Euphrates river and they can't go east because we have a huge presence there. So they are cornered in the south."

 

A little later the American headquarters inside Fallujah came under repeated fire, leading to US tanks and armoured cars heading back into areas which US forces had claimed to be firmly under control.

Rasoul Ibrahim, a father of three, fled Fallujah on foot, arriving with his wife and children yesterday in Habbaniya, 12 miles to the west. He said families left inside Fallujah were in desperate need. "There's no water," he said. "People are drinking dirty water. Children are dying. People are eating flour because there's no food." Around 10,000 people have taken shelter in Habbaniya.

US forces say they have found Mohammed al-Joundi, the Syrian driver of two abducted French journalists, Christian Chesnot and Georges Malbrunot, in Fallujah. The driver said he was being held captive by militants after being separated from the journalists, who were abducted with him in August.

 

Meanwhile, violence continued to spread, with US aircraft carrying out air strikes in Mosul and militants attacking US patrols near the centre of Baghdad with machine guns and rocket-propelled grenades. The interim government extended the curfew imposed on the capital to the Shia holy city of Najaf.

USFK Relocation Aimed at Surgical Strikes on NK: Rep. Roh

Rep. Roh Hoe-chan of the progressive Democratic Labor Party (DLP) claimed Thursday the planned realignment of U.S. Forces Korea (USFK) is based on a U.S. plan to launch surgical strikes against North Korea.

Speaking in a parliamentary interpellation session on security and foreign affairs, Roh asserted the plan was codenamed ``OPLAN 5027-04,¡¯¡¯ which was first revealed by North Korea in August when it accused the U.S. of preparing to attack the North with high-tech weapons.

``High-tech weapons together with improved C4I (command, control, communications, computers and intelligence) of the USFK will bring a huge increase in the potential of `surgical strikes¡¯,¡¯¡¯ Roh quoted a senior U.S. official who participated in the ROK-U.S. military talks in April, 2003, as saying.

``A new OPLAN will add a new form of combat capability to the conventional one, which can be expected to improve the capacity to wage war,¡¯¡¯ Roh said, quoting the U.S. official and suggesting the new plan was OPLAN 5027-04. ``The current location of the U.S. 2^nd Infantry Division is not a proper place for conducting war (against North Korea).¡¯¡¯

The OPLAN 5027-04 includes a U.S. plan to strike specific targets with sophisticated weapons, which have recently been used in the war in Iraq, and also covers the U.S.¡¯ Missile Defense system to counter possible missile attacks by North Korea, the 48-year-old lawmaker said, citing a U.S.-based security institution, Global Security.

The first term lawmaker went on to say that OPLAN 5027-02, drawn up after the 9/11 incident, also contains a plan to assassinate North Korean leader Kim Jong-il and to pre-emptively attack North Korea without consulting the South Korean government.

On Sunday Japan¡¯s Kyodo News Agency reported that as part of U.S. scenario ``5027,¡¯¡¯ which is produced every two years, 25 jet bombers flew simulated missions at an air force base in North Carolina to drop mock nuclear bombs on a firing range in Florida between January and June 1998.

``The relocation of the USFK is a part of Washington¡¯s new military strategy known as the Global Defense Posture Review (GPR),¡¯¡¯ Roh continued. ``It is outrageous for the South Korean government to insist that the relocation has nothing to do with the GPR.¡¯¡¯

Roh stressed that the U.S. should bear all the expenses regarding the USFK relocation, saying it is part of Washington¡¯s GPR plan.

``South Korea should reconsider the Seoul-Washington agreement regarding the relocation cost of the USFK to ensure sufficient discussion between the two parties, which will also help resolve the North Korean nuclear issue in a peaceful way,¡¯¡¯ Roh said.

The Torah refers to Israel as an "Am", a people, as well as a "Goy", a nation. Unlike an Am, a Goy is a corporate entity whose members are not united by a distinctive way of life.

The most prominent example of a "Goy" is multicultural America. Virtually anyone can be a citizen of this great democracy, where freedom is defined as "living as one likes". Yet, to call the United States a "democracy" is misleading insofar as that term literally means "the rule of the people".

For America is not an Am, a people united by a distinctive way of life. America is a normless democracy where citizenship has little moral or intellectual significance. The removal of virtually all moral and intellectual standards from the naturalization process has stripped citizenship in America of any dignity.

Now it so happens that the concept of citizenship, like that of the sovereign state, is foreign to the Torah. Since the state is a product of human will, so too are its laws governing citizenship. Moreover, since a defined area of land is essential to a state's existence, its laws governing citizenship will apply only to that area.

The people of Israel, however, existed before they possessed a land. Indeed, they became a people only by virtue of the Torah, and it was only after receiving the Torah were they given a land and for the sake of the Torah.

What also distinguishes the Torah is that any Jew who has converted to another religion will remain with all the obligations of a Jew until the end of time. Because Judaism is a unique philosophy and system of behavior, any person, regardless of race or ethnicity, can become a Jew by learning the Torah and living according to its precepts.

Police Tasered truant girl, 12

A Miami-Dade police officer used a Taser to stop an unarmed, 12-year-old girl who was running away from him after she was caught skipping school, police acknowledged Friday night.

The incident happened Nov. 5, just over two weeks after other Miami-Dade officers used a stun gun to restrain a first-grader. In that case, police said the 6-year-old boy was holding a shard of glass and threatening to cut himself. Police Director Bobby Parker defended the decision to shock the boy because he could have seriously hurt himself.

But Parker said Friday that he could not defend the decision to shock the fleeing 12-year-old, who was apparently drunk.

''Under the circumstances, we thought that he should not have used the Taser,'' Parker said referring to the officer. ``It's likely that discipline will be forthcoming.''

According to the incident report:

Officer William Nelson responded to an anonymous complaint that some kids were swimming in a West Kendall pool, drinking alcohol and smoking cigars about 11 a.m.

Nelson said he noticed the girl was intoxicated and told her to get dressed so he could take her back to school.

''While walking [the girl] to the police car, [she] took off running through the parking lot,'' Nelson wrote in his report.

Nelson, 38, a 15-year veteran, said he chased her and yelled several times for her to stop. Nelson said he pulled out the Taser and fired when the girl began to run into traffic.

The electric probes hit the girl in the neck and lower back, immobilizing her with 50,000 volts.

Nelson said he fired ''for my safety along with [the girl's] safety.'' He could not be reached for comment.

Paramedics treated the girl, who went home with her mother.

Parker said department policy permits officers to use the Taser to apprehend someone, but he said he expected his officers to use better judgment -- especially when police had no plans to arrest someone playing hooky.

''If you use it to apprehend an adult, it would be an arrest kind of situation,'' said Parker, adding that the timing of the latest incident couldn't be any worse.

His department is already under fire for using a Taser to subdue the 6-year-old last month. That zapping has made national headlines and prompted calls from child advocates that Miami-Dade review its Taser use.

Parker said Friday night that his department will review its Taser policy. ''That doesn't mean that we're going to change it,'' he said.

County Commissioner Joe Martinez, a former Miami-Dade officer, said the policy needs to be tightened.

''When you have a 6-year-old who is on medication and very disturbed, maybe some of that crisis intervention training would be very handy,'' he said, referring to a program that teaches officers how to deal with the mentally ill. ``Now, when I learn that a 12-year-old girl was running away, truant, and was also Tasered, I think it's time we instruct the county manager to look at that policy.''

Asked if his officers had shocked any other kids, Parker said: ``I asked the same question, are there more of these out there that I'm not aware of? To my knowledge this is the only one.''

The Israeli lobby has launched an all-out drive to ensure congressional passage of a bill, approved by the House and now before a Senate committee that would set up a federal tribunal to investigate and monitor criticism of Israel on American college campuses.

 

Ten months ago the New York-based Jewish Week newspaper claimed that the report by American Free Press that Republican members of the Senate were planning to crack down on college and university professors who were critical of Israel was "a dangerous urban legend at best, deliberate disinformation at worst." They were claiming that AFP lied.

 

However, on Sept. 17, 2003, the House Subcommittee on Select Education unanimously approved H.R. 3077, the International Studies in Higher Education Act, which was then passed by the full House on Oct. 21. The chief sponsor of the legislation was Rep. Peter Hoekstra, a conservative Republican from Michigan.

 

DANGEROUS LEGISLATION

 

Critics charge that the bill is dangerous-a direct affront to the First Amendment and the product of intrigue by a small clique of individuals and organizations which combines the forces of the powerful Israeli lobby in official Washington.

Leading the push for Senate approval of the bill are the Anti-Defamation League (ADL) of B'nai B'rith, run by Abe Foxman, the American Jewish Congress and the American Jewish Committee.

One other group has lent its support: the U.S. India Political Action Committee, an Indian-American group that has been working closely with the Israeli lobby now that Israel and India are geopolitically allied.

It would set up a seven-member advisory board that would have the power to recommend cutting federal funding for colleges and universities that are viewed as harboring academic critics of Israel.

 

Two members of the board would be appointed by the Senate, two by the House, and three by the secretary of education, two of whom are required to be from U.S. federal security agencies. The various appointees would be selected from what The Christian Science Monitor described on March 11 as "politicians, representatives of cultural and educational organizations, and private citizens."

Lisa Anderson of the Columbia University School of International and Public Affairs said in response that "this plan . . . is not about diversity, or even about the truth."

 

Ms. Anderson does not cite the role of the Israeli lobby, but instead targets conservative Republicans who are acting as the Israeli lobby's surrogates and says that this plan is "about the conviction of conservative political activists that the American university community is insufficiently patriotic, or perhaps simply insufficiently conservative."

 

What she should be saying is that these Republicans who are carrying water for Israel are concerned that universities are "insufficiently pro-Israel."

 

The Republican House members who originally joined Hoekstra in co-sponsoring this legislation should be named for the record. They are:

Sam Brownback (Kan.).

 

AFP's initial report on the legislation garnered so much attention from American college and university professors and on the Internet, even so far as the Arab world, that the resulting negative publicity forced Santorum and Brownback to back off.

Many major American education organizations, including the teacher's union, the National Education Association, have raised their concerns about this campaign to muzzle the free speech of teachers, professors and instructors. The American Civil Liberties Union has also protested this measure.

Many Christian Zionists leaders such as Falwell, Robertson and Lindsey will deny this death cult mentality they have birthed and cherished throughout their careers in their evangelical "on stage" palaces, but none the less the evidence is out in the open for anyone with half a brain to see and judge for themselves.

 

What is the aim of the Christian Zionists? The aim of the Christian Zionists movement is to conform itself to the body of Judaism so much so that the Christian Zionist movement will become a totally acceptable form of Judaism. Within this incorporation of itself into Judaism is the "natural acceptance" of Jesus Christ by the Jews as their savior, Lord and God. The completeness of God is seen in the combination of "Judeo/Christian" although acceptance in recognition of Jesus is no longer the driving force but the "ingredient" that sits on the table as salt to cure the wound. Jesus is there if the Jews want him and there even if they don't.

 

This satisfies the desire of the Christian Zionist in his new zeal to "save" the Jews for Christ; for the Christian Zionist today is more concerned with himself being accepted and approved by the hiarchy of Jewish traditionalists as evidenced by and how Christian Zionists envision their "personal" relationship with Ariel Sharon, Nutenyuhoo, and Perez. The Christian Zionist seeks "brotherhood" with these Jewish leaders of Judaism and such a brotherhood is envisioned as a most highly prized and "seized" accomplishment among the Christian Zionist evangelicals such as Falwell, Lindsey and Robertson. Convergence of two cloud fronts formed the 8,000-metre-thick connective cloud cluster.

The marvellous spectacle was also reported in many other areas of Liaoning Province and lasted for half an hour in some places, he said.

The meteorologist warned that temperatures are likely to plummet in the coming days.

‘Mystery Cloud’ Appears Over Eastern U.S. And Canada

Anyone who lives in the eastern part of the United States or Canada and gazing skyward on Tuesday evening may have noticed something strange in their west-northwest sky.

At around 9 p.m. EDT, a small, bright, silvery circular cloud of light suddenly appeared.  Over the next 25 minutes, the cloud appeared to gradually expand and fade, finally becoming invisible to the unaided eye.  Those who saw it, wondered exactly what it might have been.

John Bortle, a well-known amateur astronomer with over four-decades of experience of sky observing first caught sight of the cloud at 9:03 p.m. EDT from his home in Stormville, New York.  Initially, he thought the cloud was as bright as zero or first magnitude and upon examining it carefully with binoculars, thought that it " ... resembled the petals of a day lily."  By 9:30 p.m., he reported that the cloud had faded completely from his view.

From the North Fork of Long Island, Bill Bogardus and his wife were out observing when they took note of the cloud " ... about the size of the moon" in the northwest sky.  "It was a roundish, yet not all that round, object drifting towards our location very slowly, slower that most satellites because it took at least twenty minutes to move from where we first saw it to pretty much our zenith."

After studying it for a while through an 8-inch telescope, Bogardus noticed two points of light, " ... like a satellite would appear, in line and above a jet of gas that seemed to come from them."

Observing from Ithaca, New York,  Joseph Storch used 7x50 binoculars on the cloud and reported a star-like point or nucleus and four butterfly shaped petals radiating outward.

Other reports, received as far west as Toronto tell of people who initially thought that what they were seeing was the moon behind a cloud. Typical was the comment: "For a second I thought it was the moon, then I realized the moon was in the east."

What was it?

Not a few people who saw this strange, expanding cloud thought that it might have been an atmospheric experiment sent aloft by a sounding rocket.  Over the years, those living along the US East Coast have been accustomed to occasionally seeing unusual brightly colored clouds caused when exotic chemicals such as barium and  trimethylaluminum were released into the Earth's ionosphere by rockets launched from NASA's Wallops Island, Virginia site.

However, in this case it was the U.S. National Reconnaissance Office -- not NASA -- that was responsible for the unusual cloud formation on Tuesday night.

It was a fuel dump of the Centaur stage involved in the NRO-1 satellite launch from Cape Canaveral late Tuesday afternoon. Dumping excess fuel is the usual practice for all Centaur-booster assisted launches. It happens after spacecraft separation; the fuel bleeding off from a Centaur upper rocket stage on its second orbit after launch. Being just after nightfall, the cloud of fuel was still sunlit at that altitude.

And those who were fortuitously outside when the dump occurred, were the ones who saw this very unusual sight!

INTRODUCTION

 

Water supplies to Tall Afar, Samarra and Fallujah have been cut off during US attacks in the past two months, affecting up to 750,000 civilians. This appears to form part of a deliberate US policy of denying water to the residents of cities under attack. If so, it has been adopted without a public debate, and without consulting Coalition partners. It is a serious breach of international humanitarian law, and is deepening Iraqi opposition to the United States, other Coalition members, and the Iraqi interim government.

 

EVIDENCE FOR THE DENIAL OF WATER

 

Tall Afar

 

On 19 September 2004, the Washington Post reported that US forces 'had turned off' water supplies to Tall Afar 'for at least three days' (1). Turkish television reported a statement from the Iraqi Turkoman Front that 'Tall Afar is completely surrounded. Entries and exits are banned. The water shortage is very serious' (2). Al-Manar television in Lebanon interviewed an aid worker who stated that 'the main problem facing the people of Tall Afar and adjacent areas is shortage of water' (3). Relief workers reported a shortage of clean water (4). Moreover, the Washington Post reports that the US army failed to offer water to those fleeing Tall Afar, including children and pregnant women (5).

 

Samarra

 

'Water and electricity [were] cut off' during the assault on Samarra on Friday 1 October 2004, according to Knight Ridder Newspapers (6) and the Independent (7). The Washington Post explicitly blames 'U.S. forces' for this (8). Iraqi TV station Al-Sharqiyah reported that technical teams were working to 'restore the power and water supply and repair the sewage networks in Samarra' (9). Al Jazeera interviewed an aid worker who confirmed that 'the city is experiencing a crisis in which power and water are cut off' (10), as well as the commander of the Samarra Police, who reported that 'there is no electricity and no water' (11).

 

Fallujah

 

On 16 October the Washington Post reported that: 'Electricity and water were cut off to the city [Fallujah] just as a fresh wave of strikes began Thursday night, an action that U.S. forces also took at the start of assaults on Najaf and Samarra.' (12)

 

Residents of Fallujah have told the UN's Integrated Regional Information Networks that 'they had no food or clean water and did not have time to store enough to hold out through the impending battle' (13). The water shortage has been confirmed by other civilians fleeing Fallujah(14), Fadhil Badrani, a BBC journalist in Falluja, confirmed on 8 November that 'the water supply has been cut off'.

 

In light of the shortage of water and other supplies, the Red Cross has attempted to deliver water to Fallujah. However the US has refused to allow shipments of water into Fallujah until it has taken control of the city (15).

 

 

Other cases

 

There have been allegations that the water supply was cut off during the assault on Najaf in August 2004, and during the invasion of Basra in 2003. We have not investigated these claims.

 

JUSTIFICATIONS FOR THE DENIAL OF WATER

 

Some military analysts have attempted to justify the denial of water on tactical or humanitarian grounds. Ian Kemp, editor of military journal 'Jane's Defense Weekly', argues that: 'The longer the city [Fallujah] is sealed off with the insurgents inside, the more difficult it is going to be for them. Eventually, their supplies of food and water are going to dwindle' (16).

 

Barak Salmoni, assistant professor in National Security Affairs at the U.S. Naval Postgraduate School in Monterey, told the San Francisco Chronicle that civilians would probably be encouraged to leave Fallujah 'by cutting off water and other supplies' (17).

 

These arguments are deeply flawed on legal, humanitarian and political grounds. The majority of the population of Fallujah fled before the American attack. Those who have not already fled Fallujah are forced to remain, since roads out of the city have been blocked (18), including by British troops (19). Not only are those remaining unable to leave, but they are likely to consist largely of those too old, weak, or ill to flee - precisely the groups which will be most severely affected by a shortage of water.

 

REACTION IN IRAQ

 

The information reported above is more widely known in Iraq than in the US and UK, and has had become a significant political issue. Belief that US tactics involve denial of water is widespread. According to the LA Times: 'As soon as the women of Fallouja learned that four Americans had been killed, their bodies mutilated, burned and strung up from a bridge, they knew a terrible battle was coming. They filled their bathtubs and buckets with water...' (20)

 

Condemnations of the tactic have been issued by several major Iraqi political groups. On 1 October the Iraqi Islamic Party issued a statement criticising the US attack on Fallujah which 'cut off water, electricity, and medical supplies', and arguing that such an approach 'will further aggravate and complicate the security situation'. It also called for compensation for the victims (21).

 

Three days later Muqtada al-Sadr criticized both the denial of water to Samarra, and the lack of international outrage at it: 'They say that this city is experiencing the worst humanitarian situations, without water and electricity, but no-one speaks about this. If the wronged party were America, wouldn't the whole world come to its rescue and wouldn't it denounce this?' (22)

 

Denial of water is one of the misguided tactics which increases distrust of the Coalition forces. Asked in June how much confidence they had in US and UK forces, 50.8% of participating Iraqis responded 'none at all', with a further 29.5% saying 'not very much' (23).

 

This in turn fuels anti-American violence. A spokesman for the Association of Muslim Scholars, one of the most significant Sunni political groupings in Iraq, reported that the party's representative in Samarra had told him that 'there was no water'. He argued that partly as a result of this: 'The Iraqis no longer trust the Americans. It is not a question of military manifestations. It is now a question of popular rejection for the Americans, not for the military manifestations.' (24)

 

His analysis is confirmed by the Oxford Research International poll, according to which one third of Iraqis regard attacks against Coalition forces as 'acceptable' (25).

 

REACTION IN THE UK

 

Awareness of this issue remains extremely limited among the British public. The British government denies involvement. Despite inquiries from CASI and others, they appear not to have raised the issue with their American counterparts. UK Armed Forces Minister Adam Ingram has denied knowledge of US action to cut off water supplies in Tall Afar (26), despite coverage in the Washington Post. Similarly Hilary Benn, the UK Secretary of State for International Development, says he has not discussed the issue with his American counterparts (27). This lack of communication with the American side suggests a lack of concern for the humanitarian implications of the conflict in Iraq, and an unwillingness to comment on American activities. Concerning British forces, Mr. Ingram has claimed that: 'With regard to the action of our own Forces, I can also confirm that we have not cut off water supplies to civilians. It is possible that local temporary disruptions may have occurred at some time due to damage from combat with anti-Iraqi Forces but we are not aware of any actual cases where this has happened' (28). LEGAL IMPLICATIONS

 

The denial of water to civilians is illegal both under Iraqi and international law. Article 12 of the Transitional Administrative Law, which serves as a constitution during the interim period, states that:

 

'Everyone has the right to life, liberty, and the security of his person' (29)

 

International law specifically forbids the denial of water to civilians during conflict. Under Article 14 of the second protocol of the Geneva Conventions,

 

'Starvation of civilians as a method of combat is prohibited. It is therefore prohibited to attack, destroy, remove or render useless for that purpose, objects indispensable to the survival of the civilian population such as food-stuffs, agricultural areas for the production of food-stuffs, crops, livestock, drinking water installations and supplies and irrigation works.' (30)

 

RECOMMENDATIONS

 

CASI calls on Members of Parliament to raise this issue with ministers as a matter of urgency. The UK government must use its influence with our US ally to ensure that all military operations are conducted within the bounds of international law. In addition to the suffering caused to the civilian population, use of these tactics by US forces puts our own troops at risk from rising insurgency.

 

We hope that the issue will be taken up by international NGOs such as Amnesty International and Human Rights Watch. Deliberate disruption of civilian water supplies should be a matter of concern for all who are promoting human rights in Iraq.

 

CASI urges journalists on the ground in Iraq to investigate the above reports further, in order to build up a clearer picture of use of this tactic. The UK media must give greater weight to the plight of civilian populations in their coverage of conflicts such as Fallujah. The UK public needs to know that our Coalition partner is using this illegal tactic.

(AFP) - More than 200 soldiers wounded in Afghanistan and Iraq, mostly in the offensive on the Iraqi rebel bastion of Fallujah, have arrived at the US military hospital here over a three-day period, a spokeswoman said on Friday.

 

Thirty-four wounded were flown in on Friday, 102 were brought in on two planes on Thursday and 68 were admitted on Wednesday, making a total of 204, said spokeswoman Marie Shaw.

 

A few of the wounded were from US operations in Afghanistan or other parts of Iraq, but "most are coming from Fallujah," Shaw said.

 

"We are very busy. Another plane is expected on Saturday morning.

 

"Most of the injuries are gunshot wounds but there are also a lot of injuries from explosions or burns," Shaw added.

 

As of Friday, the hospital was treating a total of 315 soldiers from Iraq and Afghanistan, of which 107 were confined to beds while 208 were classed as walking wounded.

 

The number of intensive care beds at the hospital has been raised from 10 to 28.

 

The Landstuhl Regional Medical Center in southwest Germany is the largest US military medical facility outside the United States.

 

As of Thursday evening, the US military counted 178 of its troops wounded in the fight for Fallujah and 18 dead while five Iraqi soldiers have also died and 34 have been injured in fighting that has raged since Monday.

Police: Couple Planned to 'sacrifice' Three Children on Church Altar

ROCHESTER, N.H. (AP) - A woman and her boyfriend are accused of plotting to sacrifice the woman's three children on a church altar.

Nicole Mancini, 29, and John Thurber, 35, were arrested at St. Mary's Church on Wednesday after workers said they heard the woman say she wanted to sacrifice the boys.

"We could tell this woman was not right," said church secretary Donna Landolfi. "She said, 'Let's go make the sacrifice.'"

Mancini and Thurber were in jail Saturday on more than $25,000 bail. They were arraigned Friday on three counts each of misdemeanor child endangerment. Thurber was also charged with marijuana possession.

The children, ages 9, 7 and 2, were not harmed and were placed in state custody. Police said Thurber is the father of the youngest boy.

Police said Mancini told them that Jesus sacrificed himself for her, so she was going to sacrifice the boys to free her soul.

"Eighteen years I've been doing this and I've never come across anything like it," police Lt. Paul Callaghan said.

Mancini's attorney, Kimberly Shoen, said her client meant the children no harm.

"They were never tied to the altar, there was no blood, there were no constraints for sacrificial use," she said.

Linda Slamon, Thurber's attorney, said Mancini had been acting "irrationally" recently and Thurber accompanied her to the church to get her help.

"If anything, he was there to protect the children and protect Miss Mancini," Slamon said.

A judge ordered Mancini, of Rochester, to undergo a mental evaluation.

The Courts Public Record will contain judgments rendered by the court, which the litigants have agreed to disclose for the public. Otherwise, we will have be bound as a corporation sole to maintain records, which a judge in the current court system may view only in camera. However, if we are acting as a court which we assize according to scriptural law we would not be bound to maintain records of matters of private matters.

JURISDICTION

The jurisdiction of the court is not based on region but is association based and topic based. If there are members of the association which bring a question or dispute before the court then that question or dispute must have a claim which alleges jurisdiction of the court and shows relevance of the current question on the basis of rights of membership of the individual in the association. Furthermore, the claim of jurisdiction must show topical relevance to other related decisions of the court which have been made public in the public record.


Authority of The Court

The authority of the court is based upon Malchut (sovereign status) of the judge, on the basis of Daat (individual knowledge of the Divine Will) which is limited within a particular area of expertise of the judge, within Torah Law. Also the judgments of the judge must have Midat HaRachamim?. Associated with every recorded judgment the measure of mesirat Nefesh (self-sacrifice to judge the case to its truth Sanhedrin 6b?) must be documented. The Public Record of judgments of the court must show not only the nominal judgment but also a listing of motions considered based and a summary of the state of stare decisis at the hearing of the motion derived from the documented references to the claims of the litigants making and opposing the motion. In other words, if the judge is not as qualified as another judge based on his record of performance, the matter may be referred to a different court.

INDICTMENT

A claim/question is indictable (that is it is considered worthy of consideration by the court) if the claim falls within the jurisdiction of the court and it is claimed that there is evidence to support the claim.


REFERENCE

The court may refer a case which is not within its jurisdiction to another court which has jurisdiction.


THE RECORD

Now, the way that this court filing system works is as follows:
There is a Master List of Claims for Declaratory Judgement, by which we mean a question of a matter of Noahide Law, as opposed to a dispute. These may be actual sheilot (Questions for judgment) or Eitzot (Requests for Advice). Answers to questions of Noahide law by Rabbinical Authorities will not be published or even seen by us. We will recommend a posek, and that is all . You will address the question directly to the posek. Our classification of the case will be released if you approve of the classificatioin and give us written permission. The posek will answer you directly. However, if the posek and the questioner concerned gives written permission to release that answer that it be published in our database then we may publish it, or the posek independently publishes the answer in the responsa literature then that sefer (published book of law) can be referenced in our database.


THE FILING PROCESS


The questioner to use the service must file his question as a halachic question (question of Torah Law).
The question is then classified/discriminated from similar catalogued questions, by issue. The questioner will be asked to distinguish his question from similar publishable questions.
