It is really called “The Tower of Babel,” but the reversal makes for an intriguing headline, and also reflects the current confounding confusion in Iraq a/k/a Babylon. Actually, we’re no strangers to that part of the world; it is the place of our original roots, and we have vivid Babylon memories, both good and bad. Ur of the Chaldees in Southern Iraq was the birthplace of our ancestor Abraham, before G-d directed him to head west to Israel. Los Angeles County Supervisors decided to turn tail and run rather than fight a lawsuit threatened by the Jewish-controlled, American Civil Liberties Union.

 

Why such weak-kneed response? Because lawyers for the county ominously warned that the county might lose the case and have to pay the Jewish-ACLU's attorney's fees.

 

The ACLU is demanding that the county remove a tiny cross from its seal, one of nearly a dozen symbols it portrays. One need only look at the seal to see just how ridiculous is the ACLU's demand.

 

A third of the seal and the centerpiece is the Greek goddess Pomona standing on the shore of the Pacific Ocean. The Jewish-powered ACLU doesn't object to her; portrayals of pagan goddesses are OK.

 

Six side sections of the seal depict historical motifs: the Spanish galleon San Salvador, a tuna fish, a cow, the Hollywood Bowl, two stars representing the movie and television industries, oil derricks and a couple of engineering instruments that signify industrial construction and space exploration. The cross is so tiny that it doesn't even have its own section and consumes maybe 2 percent of the seal's space.

 

Removing the cross is a blatant attempt to erase history and make the Jews kings of the United States, and to drop it down the "memory hole" as George Orwell would say. It is just as reasonable to recognize the historical fact that California was settled by Christians, not the vicious Jew, who built missions all over the state as it is to honor the Spanish ship, the San Salvador, which sailed into San Pedro Harbor on Oct. 8, 1542.

 

The reason that the Los Angeles County seal is such a big deal is not because it is a violation of the First Amendment. It is because there is a pot of gold hidden under it attracting the Jewish ACLU like honey attracts bees. A little-known 1976 federal law called the Civil Rights Attorney's Fees Awards Act enables the Jew-ACLU to collect attorneys' fees for its suits against crosses, the Pledge of Allegiance, and the Ten Commandments. This law was designed to help plaintiffs in civil rights cases. But the ACLU is using it for First Amendment cases, asserting that it is a civil right NOT to see a cross or the Ten Commandments.

 

The financial lure created by this law is the engine that drives dozens of similar cases nationwide. Every state, county, city, public park or school that has a cross, a Ten Commandments monument, or recites the Pledge of Allegiance, has become a target for ACLU fundraising.

 

There are thousands of Ten Commandments plaques or monuments all over the country, and lawsuits to remove them have popped up in more than a dozen states. In Utah, the ACLU even announced a scavenger hunt with a prize for anyone who could find another Ten Commandments monument that the ACLU could persuade an activist judge to remove.

 

The most famous Ten Commandments monument case is the one in the State Judicial Building in Montgomery, Ala., installed by former Chief Justice Roy Moore and ordered removed by a Carter-appointed federal judge. As their reward for winning its removal, the ACLU, Americans United for Separation of Church and State and the Southern Poverty Law Center collected $540,000 in attorney's fees and expenses from Alabama taxpayers.

 

Kentucky taxpayers have handed over $121,500 to pay the Jewish ACLU for its action against the Ten Commandments display outside its state capitol. Taxpayers in one Tennessee county had to pay $50,000 to the ACLU for the same "offense."

 

The ACLU profited enormously, collecting $790,000 in legal fees, plus $160,000 in court costs, as a result of its suit to deny the Boy Scouts of America the use of San Diego's Balboa Park for a summer camp, a city facility the Scouts had used since 1915. The ACLU argued that the Boy Scouts must be designated a "religious organization" because it refuses to accept homosexual scoutmasters, and because the Scouts use an oath "to do my duty to God and my country."

 

In northern Minnesota, the Duluth city council voted 5-4 to acquiesce to the ACLU's demand to remove a Ten Commandments monument from public property because the city couldn't afford to pay the legal costs of defending the monument, plus the ACLU's legal fees. Redlands, Calif., likewise backed down after the ACLU threatened a lawsuit to force removal of a cross from part of the city logo.

 

Similar lawsuits could challenge "under God" in the Pledge of Allegiance, since the U.S. Supreme Court ducked deciding the issue June 14 in the Michael Newdow case. There are 16,000 public school districts that could become targets of lawsuits to ban the pledge.

 

Rep. John N. Hostettler, R-Ind., has introduced H.R. 3609 to end this racket by amending the federal law that makes it possible. Most lawsuits do not award attorney's fees to the winner, and the law should not give a financial incentive to those suing to stop our acknowledgment of God, or to continue a practice or a symbol that the U.S. people have approved for decades.

In a letter to Texas Republican Party officials by the Southwest Region and North Texas Regions of the Anti-Defamation League, ADL expressed concern about the party's recently adopted platform declaring the United States to be "a Christian nation" and referring to the "myth" of the separation of church and state.

 

ADL is deeply concerned by the "Christian nation" language. Calling America a "Christian nation" diminishes the fact that our country is a democratic nation founded on and embodying the principle of diversity, including religious diversity. Religion has flourished in America precisely because of America's respect and commitment to its diversity and pluralism, and we call on Democrats and Republicans alike, to be mindful that America is home to people of all faiths and backgrounds. The separation of church and state is no myth; rather it is a fundamental principle of our democracy.

 

ADL urges the Texas GOP to modify language in its party platform to reinforce principles and values that unite our diverse nation, rather than issue statements with the potential to divide our citizenry.

Bush Claimed Right to Waive Torture Laws

WASHINGTON (AP) - President Bush claimed the right to waive anti-torture laws and treaties covering prisoners of war after the invasion of Afghanistan, and Defense Secretary Donald Rumsfeld authorized guards to strip detainees and threaten them with dogs, according to documents released Tuesday.

The documents were handed out at the White House in an effort to blunt allegations that the administration had authorized torture against al-Qaida prisoners from Afghanistan and Iraq.

"I have never ordered torture," Bush said. "I will never order torture. The values of this country are such that torture is not a part of our soul and our being."

The memos were meant to deal with an election-year headache that followed revelations about abuses at Abu Ghraib prison in Iraq, but the documents also brought to light some practices that the administration decided had gone too far. Amnesty International revived its call for the appointment of a special counsel to investigate any torture and ill-treatment of prisoners in U.S. custody.

The Justice Department disavowed a memo written in 2002 that appeared to justify the use of torture in the war on terror. The memo also argued that the president's wartime powers superseded anti-torture laws and treaties.

That 50-page document, dated Aug. 1, 2002, will be replaced, Justice Department officials said. White House counsel Alberto Gonzales said that some legal memos contained "unnecessary and overbroad discussions" that could be "subject to misinterpretation." But he added, "The analysis underpinning the president's decisions stand and are not being reviewed."

A new memo will instead narrowly address the question of proper interrogation techniques for al-Qaida and Taliban detainees, the Justice Department said.

Bush had outlined his own views in a Feb. 7. 2002, document regarding treatment of al-Qaida detainees from Afghanistan. He said the war against terrorism had ushered in a "new paradigm" and that terrorist attacks required "new thinking in the law of war." Still, he said prisoners must be treated humanely and in accordance with the Geneva Conventions.

"I accept the legal conclusion of the attorney general and the Department of Justice that I have the authority under the Constitution to suspend Geneva as between the United States and Afghanistan, but I decline to exercise that authority at this time," the president said in the memo, entitled "Humane Treatment of al-Qaida and Taliban Detainees."

 

Explaining Bush's memo, Gonzales said the United States "is fighting "an enemy that does not fight, attack or plan according to accepted laws of war - in particular the Geneva Conventions."

In a separate Pentagon memo, dated Nov. 27, 2002, the Defense Department's chief lawyer, William J. Haynes II, recommended that Defense Secretary Rumsfeld approve the use of 14 interrogation techniques on detainees at Guantanamo Bay, such as yelling at a prisoner during questioning and using "stress positions," like standing, for up to four hours.

Haynes also recommended approval of one technique among harsher methods requested by U.S. military authorities at Guantanamo: use of "mild, non-injurious physical contact such as grabbing, poking in the chest with the finger and light pushing."

Among the techniques that Rumsfeld approved on Dec. 2, 2002, in addition to the grabbing, the yelling and the stress positions:

- Use of 20-hour interrogations.

 

- Removal of all comfort items, including religious items.

- Removal of clothing.

- Using detainees'"individual phobias such as fear of dogs to induce stress."

Rumsfeld scribbled a note on Haynes' memo that said, "However, I stand for 8-10 hours a day. Why is standing limited to 4 hours."

In a Jan. 15, 2003, note, Rumsfeld rescinded his approval of Haynes' recommendations and said a review would be conducted to consider legal, policy and operational issues relating to interrogations of detainees held by the U.S. military in the war on terrorism.

 

Rumsfeld's decision was prompted at least in part by objections raised by some military lawyers who felt that the techniques might go too far, officials said earlier this year.

The review was completed in April 2003, and on that basis Rumsfeld reissued his guidance on April 16, 2003. He approved 24 interrogation techniques, to be used in a manner consistent with the Geneva Conventions, but said that any use of four of those methods would have to be approved by him in advance: the use of rewards or removal of privileges; attacking or insulting the ego of a detainee; alternating the use of friendly and harsh interrogators, and isolation.

The April 2003 review said that removing a detainees' clothing would raise legal issues because it could be construed as degrading, which is against the international convention on torture. The removal of clothing, approved by Rumsfeld for use at Guantanamo Bay in late 2002, was not among the authorized techniques in his revised guidelines issued in April 2003.

At the Justice Department, senior officials said that the 50-page memo issued to the White House on Aug. 1, 2002, would be repudiated and replaced.

The memo, signed by former Assistant Attorney General Jay Bybee, included lengthy sections that appeared to justify use of torture in the war on terrorism and it contended that U.S. personnel could be immune from prosecution for torture. The memo also argued that the president's powers as commander in chief allow him to override U.S. laws and international treaties banning torture.

Critics on Capitol Hill and elsewhere have said that memo provided the legal underpinnings for subsequent abuses of prisoners in Afghanistan and Iraq.

Reacting to the White House release, Vermont Sen. Patrick Leahy, the senior Democrat on the Judiciary Committee, accused the administration of continuing to withhold information.

"Though this is a self-serving selection, at least it is a beginning," Leahy said. "But for the Judiciary Committee and the Senate to find the whole truth, we will need much more cooperation and extensive hearings."
