Diskin Pessimistic About Israel´s Security

Yuval Diskin, the new head of Israel’s clandestine domestic
security agency, the Shin Bet, made his first appearance before the Knesset
Foreign Affairs and Defense Committee on Tuesday, two days after assuming his
post.
Diskin painted a bleak picture of Israel’s security situation leading up to
the execution of the expulsion plan and it’s aftermath,

citing the possibility that terrorists would begin firing missiles into Israel from northern Samaria, and the problems Israel would face combating Hamas, if the terror group becomes part of the official body governing the Palestinian Authority.

the firing of missiles” at Israeli targets, leaving the IDF without “an
effective method of fighting terror in the region.”

PA, if IDF forces withdraw totally from the Gaza district. He took the line of
his predecessor, Avi Dichter, who opposed the government’s plan to abandon the
route to PA forces and rely on beefed-up Egyptian forces to secure the border
from their side.

Recent polls show Hamas scoring big gains in the upcoming PA elections scheduled
for July 17, about one month before the government goes ahead with its plans to

Hamas made significant inroads in last month’s municipal elections in the PA,

Diskin presented a pessimistic view of PA chief Mahmoud Abbas’ efforts to

fight terror nor give up the Palestinians’ claim to the “right of return”
which if implemented, would flood Israel with hundreds of thousands of Arab
refugees and their descendents from the 1948 and 1967 wars.

Quarter of a million Israelis cannot marry or get a divorce

More than 280,000 Israeli citizens cannot marry
or divorce in Israel because they do not belong to a legally
recognized religious group, according to figures presented yesterday to
the Knesset Immigration and Absorption Committee.
Israeli law does not recognize civil marriage, and requires citizens to be
married by their own clergy. Religious groups were determined during the Turkish
period, which ended in 1917.![]()
The Central Bureau of Statistics says that at the end of 2003, some 254,000 citizens were listed as "lacking religious classification," and about 27,000 as "Christians who are not Arab."

percent of these groups, or 219,000, are natives of the former Soviet Union, who
came to live in Israel by virtue of the Law of Return; 3 percent are Ethiopian;

MK Yosef Paritzky (Shinui), who had called for the discussion on this issue,
called it "crazy" that the state does not permit a quarter of a
million people to marry and divorce, and Committee chair Colette Avital (Labor)
called the situation "a time bomb."
The committee also heard yesterday that in 2002, 1,585 Israeli citizens lacking
religious classification married abroad - 780 men and 805 women. In the main age
group of Israelis marrying, age 20 to 32, the number of people lacking religious
classification is about 83,000

GAZA CITY, 17 May 2005 — Israel will begin work on a wall that will create a corridor linking the largest Jewish settlement in the West Bank to Jerusalem next month, weeks before it starts withdrawing from the Gaza Strip. The construction will in effect expand Jerusalem’s boundaries and cut off Palestinians from the city they seek as a future capital.
By starting work on the section around Maale Adumim just weeks before Israel begins pulling its troops and settlers out of the Gaza Strip, the government is hoping to minimize US and EU opposition, the Maariv newspaper said. Under wider plans, not only Maale Adumim, but also Gush Etzion, a settlement bloc home to around 12,000 Israelis near Bethlehem, would be incorporated onto the Israeli side of the barrier whose final route was approved by the Cabinet in February, Maariv reported.
The barrier around Maale Adumim will also take in other smaller nearby settlements and land earmarked for the construction of new Jewish neighborhoods.
Israel has insisted that the wall’s only purpose is to prevent infiltrations by would-be Palestinian attackers. The Palestinians, however, point to its route, which often juts into the occupied territory, as proof that its real purpose is to predetermine the borders of their promised future state.
Meanwhile, Israel yesterday banned former Malaysian Premier Mahathir Mohamad, whose comments have in the past infuriated Jews, from entering Jerusalem while visiting the West Bank.
Mahathir was delayed for an hour at the Allenby crossing from Jordan into the West Bank where Israeli officials banned him from going to Jerusalem or the city of Jenin in the West Bank, Palestinian Prime Minister Ahmed Qorei said.
“I want to say to the entire world that this is the political mind of the occupation,” Qorei told a joint news conference with Mahathir in the West Bank city of Ramallah.
“This is an important man, an international man and the Israelis prevent him from going to Jerusalem, they prevent him from going to Jenin,” he added, expressing his apologies.
The Israeli authorities, which continue to control the entrance into towns throughout most of the West Bank as well as controlling the border into Jordan, said they had received no advance warning of Mahathir’s arrival.
“We received no request to facilitate the visit. We weren’t aware he was coming, so we didn’t deal with it,” said a Foreign Ministry spokesman

Pakistan dismisses Newsweek retraction on KoranMay 17, 7:49 AM (ET)
ISLAMABAD (Reuters) - Pakistan dismissed on Tuesday as inadequate an apology and retraction by the Newsweek magazine of a report that U.S. interrogators at Guantanamo Bay had desecrated the Koran.
The report in the magazine's May 9 issue sparked protests across the Muslim world, from Afghanistan, where 16 people were killed and more than 100 injured, to Pakistan, India, Indonesia and Gaza.
"The apology and retraction are not enough," Information Minister Sheikh Rashid Ahmed told Reuters.
"They should understand the sentiments of Muslims and think 101 times before publishing news which hurt feelings of Muslims."
The magazine retracted the story on Monday.
Newsweek said in its May 23 edition that the information had come from a "knowledgeable government source" who had said a military report on abuse at Guantanamo Bay had found interrogators had flushed at least one copy of the Koran down a toilet in a bid to make detainees talk.
But the source later told the magazine he could not be certain he had seen an account of the Koran incident in the military report and that it might have been in other investigative documents or drafts, Newsweek said.
The Newsweek retraction came as the White House, the Pentagon and the State Department all strongly criticized the report and said it had damaged Washington's image abroad.
Pakistan, a key ally in the U.S.-led war on terrorism, has called on Washington to conduct an inquiry and to share results with Islamabad.
The Pentagon has said that an investigation remained open into allegations contained in the report.
Qazi Hussain Ahmed, head of a hardline six-party Islamic alliance in Pakistan, said Newsweek's retraction was unlikely to cool tempers in the Muslim world.
"Whatever magazine has done now is under pressure (from the U.S. government)," he said. "It has not denied what it has reported and many people freed from Guantanamo Bay have narrated the same thing."
He referred to a report in the Tuesday edition of the Pakistani daily The News that quoted Hafiz Ehsan Saeed, a former detainee at Guantanamo Bay, as saying that the Koran was routinely desecrated at the U.S. prison.
Saeed was released from Guantanamo Bay in September but has since been held in a Pakistani jail in Rawalpindi, a garrison town close to Islamabad. His reported remarks could not be independently verified

Urged to Do More to Repair Damage

WASHINGTON (AP) - The White House says Newsweek took a "good first step" by retracting its story that U.S. investigators found evidence interrogators at Guantanamo Bay desecrated the Quran, but it wants the magazine to do more to repair damage caused by the article.
Newsweek on Monday retracted the report in its May 9 issue after officials in the White House, the Pentagon and the State Department criticized its publication and its use of an anonymous source. Protests in Afghanistan, where more than a dozen people died and scores were injured in rioting, and demonstrations elsewhere in the Muslim world were blamed on the article.
"The report had real consequences," White House press secretary Scott McClellan said Monday. "People have lost their lives. Our image abroad has been damaged.

Daniel Klaidman, Newsweek's Washington bureau chief, said Tuesday in an interview on CBS'"The Early Show" that the magazine will "continue to look at how we put together this story, learn from mistakes that we've made and make improvements that are appropriate as we go along."
Asked if anyone involved in preparing the article would lose his job, Klaidman said, "We think that people acted responsibly and professionally and ... there was no malice, no institutional bias, just a mistake that was made in good faith." The article was written by Michael Isikoff, an investigative reporter, and John Barry, a national security correspondent for the magazine.

On Capitol Hill, military leaders were questioned about the Newsweek account after testifying about base closings.
"We've not found any wrongdoing on the part of U.S. service members," said Gen. Richard Myers, chairman of Joint Chiefs. He said the Pentagon has investigated the claims, but he did not indicate whether the investigation was complete.
Newsweek editor Mark Whitaker said the magazine decided to publish the short item after hearing from an unnamed U.S. official that a government probe had found evidence a Quran had been flushed down a toilet by interrogators.
But on Friday, a top Pentagon spokesman told the magazine that a review of the military's investigation concluded "it was never meant to look into charges of Quran desecration." The spokesman also said the Pentagon had looked into other charges by detainees that the Quran had been desecrated and found them to be "not credible."
Whitaker said the magazine's original source later said he could not be sure he had read about the alleged Quran incident in the report Newsweek cited and that it might have been in another document.
"Based on what we know now, we are retracting our original story that an internal military investigation had uncovered Quran abuse at Guantanamo Bay," Whitaker said.
The Newsweek report was not the first public airing of allegations about U.S. personnel at Guantanamo Bay desecrating a Quran. In August and October 2004 there were news reports based on a lawsuit and a written report by British citizens who had been released from the prison in Cuba. They claimed abuse by U.S. guards, including throwing their Qurans into the toilet.
In January, Kristine Huskey, a lawyer representing Kuwaitis detained at Guantanamo, said they claimed to have been abused and in one case a detainee watched a guard throw a Quran into a toilet

A group of rabbis and human rights advocates urged the U.S.
government Wednesday to step up efforts to help reclaim a collection of
religious texts held for two decades by the Russian government, Associated Press
reported.
At a hearing of the U.S. Helsinki Commission, rabbis
affiliated with the Chabad-Lubavitch
movement — an ultra-Orthodox Jewish group — said Russia’s
refusal to return the works despite years of negotiations violates international
law and deprives them of part of their cultural heritage.
“To us, their value is not about art and perhaps not even sanctity, but
family,” said Rabbi Yehuda Krinsky, chairman of Chabad’s
social services and educational organizations. “These books are like human
beings. They give life to life.”

greater attention to the Chabad
community’s attempts to retrieve the texts.
Most of the texts were seized over 80 years ago from Rabbi Yosef Yitzchak

Revolution.
The hearing is the latest chapter in Chabad’s
20-year effort — with the help of U.S. officials — to reclaim the
collection. Last month, all 100 senators
signed a letter urging the Russian government to return the works to Chabad.

Putin during his meeting with President George W. Bush last month in Bratislava,

Edward O’Donnell Jr., the State Department’s special envoy for Holocaust

Russian officials have been reluctant to return the collection, fearing it would
lead to claims by others whose assets were confiscated by the Soviet state and
ended up in state-run cultural institutions.
Actor and human rights advocate Jon Voight,

called the books “the voices of the ancestors of the Hebrew nation. For anyone
else to claim them as their own is a reminder of all the anti-Semitic pollution
through the years of genocide and destruction of human life.”
In December 2002, the Russian government returned some of the books to the Chabad-Lubavitch
movement. But that was only a tiny portion of the collection, and the Russian
State Library has the rest. Other religious texts, thought to be destroyed in
the Nazi occupation of Warsaw, are being held at the Russian State Military
Archive.
The books are known as the “Schneerson collection,”
named for the prominent Lubavitcher family that included the Rabbi Menachem
Schneerson, the charismatic leader of the largest group of Hasidic Jews, a major
force in Judaism that may number from tens of thousands to a million or more. He
died in 1994.
In a statement to the commission Wednesday, the Russian embassy called it “inappropriate”
to involve Congress in the dispute. “It is our position that the
collection belongs to Russia,” the statement said. “It is part of the national
cultural heritage of Russians and of Jewish communities around the world.”
The dispute also is the subject of a lawsuit Chabad
filed last year against the Russian Federation in a federal court in Los Angeles

To whom it may concern:
My purpose in writing this document is to attest to the fact that efforts to retrieve the so–called Schneerson Library from the Russian Federation were undertaken during both Clinton administrations, persistently and at the highest levels of the government.
My narrative actually begins, however, in 1992, when I first met Rabbi Cunin and his sons. At that time, I was working for then-Senator Albert Gore, Jr., as his aide for national security affairs. The Cunins appeared in the reception room of Gore's Senate office, asking for an opportunity to talk with anyone who might help them. I was contacted, responded, and our association began at that point.
The Cunins described the history of the collection and their efforts to secure it from the Lenin Library in Moscow, where it had been traced after nearly three quarters of a century, as the result of some effective research and sleuthing. They asserted that President Yeltsin had personally committed to President Bush that the books would be returned, but that action had not been forthcoming. I established the accuracy of their report in telephone conversations with contacts in the Department of State who had personal knowledge of the circumstances, including President Yeltsin's commitments. It seemed to me that failure to act on this commitment would be a potentially significant test of Russian fidelity to other potential commitments. I also felt that Russian reaction to the Cunins' efforts to secure the books were also a good gauge for measuring the underlying strength of anti–Semitism in Russia.
Senator Gore was already a known figure in Moscow, because of his leadership in arms control and environmental issues. With his permission, I added “the books” to his agenda. Materials already submitted as part of the present legal action trace some of the ensuing initiatives in terms of correspondence between Senator Gore and the Russian government, as well as other forms of communication in the form of petitions from the US Senate.
When Senator Gore became Vice President, I joined him as his national security adviser and remained in that position for both of his terms. We carried the issue of the books into the White House and it became not only an objective of the Vice–President’s but of the administration as a whole, including the President.
In 1992 Presidents Clinton and Yeltsin agreed to establish the US–Russian Bi-national Commission, to be chaired jointly by Vice President Gore and Prime Minister Chernomyrdin. This group became a central element in the relationship between both countries, and led to regular working sessions in Moscow, Washington and other locations. Mr. Gore's visits to Moscow almost involved a meeting with President Yeltsin, and P.M. Chernomyrdin’s visits to Washington would routinely include a meeting with President Clinton.
The books would always be part of preparatory contacts and then, on most occasions would be raised by the Vice President directly with both Chernomyrdin and Yeltsin, and less regularly, by President Clinton in his contacts with Yeltsin. In Moscow, the issue was pursued very persistently by a succession of US ambassadors, including ambassadors Pickering and Collins. Both ambassadors would accompany me when I was in Moscow to staff Commission meetings, to negotiating sessions about the books with ranking Russian officials, including the Russian Minister of Culture.
These negotiations resulted in the only occasions when books were released from the collection to come to the United States. On one occasion, a single book was released to Vice President Gore, who turned it over to Rabbi Cunin. On a second occasion, seven or so volumes were turned over to President Clinton in the course of a summit visit to Moscow.
Unfortunately, that is as far as we were able to get, notwithstanding repeated assurances from the Russian side, from Chernomyrdin on down, that the matter would be completed soon and in full. As an interim step, aided by ambassador Pickering, I negotiated a memorandum of understanding with then-Russian Minister of Culture, Mr. Sidorov, under the terms of which the books would be placed in more appropriate locations within the library complex. Two things should be noted regarding this agreement: first, that it was explicitly intended to be an interim measure, pending full disposition of the books, and was not considered to prejudice the position of either side on that point; and second, that the agreement was between governments–Chabad was not a formal party to them. For some time there were delays in execution on the Russian side, based on one problem or another. I cannot recall ever having been informed that the terms of the memorandum had been executed.
Russian obduracy on this issue remained both a great frustration and a mystery, given the many other problems that were being solved successfully during the eight years of the Clinton⁄Gore administration. My colleagues and I interpreted the difficulty to be a reflection of the political weakness of Russian governance at the time, involving an ongoing social and economic crisis, in the context of which the issue of the Schneerson Library seemed to arouse a mix of injured national feeling and old–time anti–Semitism.
The Russians themselves advanced various other defenses including a fear that returning the books would open Russian museums to a flood of other demands for returns of works “acquired” by the state during the Soviet period. We might have been more sympathetic to this concern had it not been for the wholesale return of religious texts and other treasures to the Orthodox Church during this period: a clear–cut distinction based obviously on the growing political importance of the Church during these years.
Neither were we persuaded by the alternative Russian argument that the Schneerson library was a national treasure, in view of certain facts: (1) the collection had been completely hidden from view for nearly a quarter of a century, and its existence only revealed when tracked down by outsiders; (2) I personally saw the circumstances in which this “treasure” was stored in the deeper stacks of the Lenin library, and, even making allowances for its extremely low budget, it was clear to me that the books were not being held under conditions of respect; and (3) the fire-bombing of the Chabad office in Russia, and the destruction by arson of the Marina Roscha synagogue in Moscow, were reminders that if the Russian government thought of the books as a national treasure, elements of Russian society certainly did not have the same opinion of the Jewish people, from whose midst the books had come. I continue to hope that the rightfulness of Chabad’s claim will ultimately be recognized in Russia, and the books returned to the keeping of those for whom they are living, sacred texts.

Dr. Mikhail Oshtrakh, the president of the Jewish National Autonomy of Sverdlovsk Oblast, sent a written appeal to the mayor of Yekaterinburg, the governor of the Sverdlovsk region, and the presidential plenipotentiary for the Urals region demanding that criminal charges be brought against the local diocese of the Russian Orthodox Church (ROC). Dr. Oshtrakh, who is also a partner with the humanitarian assistance program of UCSJ's affiliate Chicago Action for Jews in the Former Soviet Union, informed UCSJ that the ROC is distributing a book written before the Russian Revolution by Sergey Nilus containing excerpts from his infamous forgery-- "The Protocols of the Elders of Zion." The "Protocols," which purports to be a record of a secret meeting of powerful Jews planning to control the world, was used by Hitler as a justification for the Holocaust.

According to Dr. Oshtrakh, the book was published in St. Petersburg by the Orthodox Publishing house with the blessing of ROC Bishop Afanasy. In Yekaterinburg, it is being sold for 102-107 rubles a copy.
Dr. Oshtrakh's action against the ROC's illegal distribution of Nilus' book has been widely covered in the regional print and television media. Unfortunately, it has also led to a public attack on him by the leader of the city's Chabad community, whose spokeswoman told the media that while the Chabad leadership looks upon the publication of Nilus' book "unfavorably," it "is not a reason for religious or political scandals" and "we have long-standing and very friendly relations with the Yekaterinburg [ROC] diocese." Obviously seeking to exploit this disagreement within the Jewish community, a representative of the ROC diocese publicly advised Dr. Oshtrakh to stay in closer touch with the Chabad and not try to "score political points for himself."

This view [of R. Isaac the smith] conflicts with that of R. Miyasha; for R. Miyasha said: If a heathen [son of Noah] blasphemed, employing substitutes of the ineffable Name, he is in the opinion of the Sages punishable by death. Why so? — Because it is written, as well the stranger, as he that is born in the land [when he blasphemeth the name of the Lord, shall be put to death].29 This teaches that only the stranger [i.e.. a proselyte], and the native [i.e., a natural born Israelite] must utter the ineffable Name; but the heathen is punishable even for a substitute only. But how does R. Meir interpret the verse, 'as well the stranger, as he that is born in the land'? — It teaches that the stranger and citizen are stoned, but a heathen is decapitated. For I would think, since they are included [in the prohibition], they are included [in the manner of execution too]: hence we are taught otherwise. Now how does R. Isaac the smith interpret the verse, 'as well the stranger, as he that is born in the land', on the view of the Rabbis?30 — It teaches that only a stranger and a native must revile the Name by the Name, but for a heathen this is unnecessary. Why does the Torah state any man?31 — The Torah employed normal human speech.32
Our Rabbis taught: seven precepts were the sons of Noah commanded: social laws;33 to refrain from blasphemy, idolatry; adultery; bloodshed; robbery; and eating flesh cut from a living animal.34

Johanan answered: The Writ saith: And the Lord God commanded the man saying, of every tree of the garden thou mayest freely eat.3 And [He] commanded, refers to [the observance of] social laws, and thus it is written, For I know him, that he will command his children and his household after him, and they shall keep the way of the Lord, to do justice and judgment.4 The Lord — is [a prohibition against] blasphemy, and thus it is written, and he that blasphemeth the name of the Lord, he shall surely be put to death.5 God — is [an injunction against] idolatry, and thus it is written, Thou shalt have no other gods before Me.6 The man — refers to bloodshed [murder], and thus it is written, Whoso sheddeth man's blood, by man shall his blood be shed.7 Saying — refers to adultery, and thus it is written, They say, If a man put away his wife, and she go from him, and became another man's.8 Of every tree of the garden — but not of robbery.9 Thou mayest freely eat — but not flesh cut from a living animal.10
When R. Isaac came,11 he taught a reversed interpretation. And He commanded — refers to idolatry; God [Heb. elohim] to social law. Now 'God' may rightly refer to social laws, as it is written, And the master of the house shall be brought unto elohim [i.e., the judges].12 But how can 'and He commanded' connote a prohibition of idolatry? — R. Hisda and R. Isaac b. Abdimi-one cited the verse, They have turned aside quickly out of the way which I commanded them: they have made them a molten calf, etc.13 And the other cited, Ephraim is oppressed and broken in judgment, because he willingly walked after the commandment.14 Wherein do they differ? — In respect of a heathen who made an idol but did not worship it: On the view [that the prohibition of idolatry is derived from] they have made them a molten calf, guilt is incurred as soon as the idol is made [even before it is worshipped]; but according to the opinion that it is from, because he willingly walked after the commandment, there is no liability until the heathen actually follows and worships it. Raba objected: Does any scholar maintain that a heathen is liable to punishment for making an idol even if he did not worship it? Surely it has been taught: With respect to idolatry, such acts for which a Jewish Court decrees sentence of death [on Jewish delinquents] are forbidden to the heathen; but those for which a Jewish Court inflicts no capital penalty on Jewish delinquents are not forbidden to him.15 Now what does this exclude? Presumably the case of a heathen who made an idol without worshipping it?16 R. Papa answered: No. It excludes the embracing and kissing of idols.17 Of which idols do you say this? Is it of those whose normal worship is in this manner; but in that case he is surely liable to death? — Hence it excludes the embracing and kissing of idols which are not usually worshipped thus.

Aha b. Jacob answered thus: The Baraitha informs us that they were commanded to set up law courts in every district and town. But were not the sons of Noah likewise commanded to do this? Surely it has been taught: Just as the Israelites were ordered to set up law courts in every district and town, so were the sons of Noah likewise enjoined to set up law courts in every district and town! — But Raba answered thus: The author of this Baraitha [which states that social laws were added at Marah] is a Tanna of the School of Manasseh, who omitted social laws and blasphemy23 [from the list of Noachian precepts] and substituted emasculation and the forbidden mixture [in plants, ploughing. etc.].23 For a Tanna of the School of Manasseh taught: The sons of Noah were given seven precepts. viz., [prohibition of] idolatry, adultery, murder, robbery, flesh cut from a living animal, emasculation and forbidden mixtures. R. Judah said: Adam was prohibited idolatry only, for it is written, And the Lord God commanded Adam.24 R. Judah b. Bathyra maintained: He was forbidden blasphemy too. Some add social laws. With whom does the following statement of Rab Judah in the name of Rab agree: viz., [God said to Adam,] I am God, do not curse Me; I am God, do not exchange Me for another; I am God, let My fear be upon you?25 — This agrees with the last mentioned [who adds social laws to the list].
Now, what is the standpoint of the Tanna of the School of Manasseh? If he interprets the verse, And the Lord God commanded etc. [as interpreted above], he should include these two [social laws and blasphemy] also, and if he does not, whence does he derive the prohibition of the rest? — In truth, he does not accept the interpretation of the verse, 'And the Lord God commanded etc., but maintains that each of these [which he includes] is separately stated: Idolatry and adultery.
