DAMASCUS (AFX) - A car that exploded in the Syrian capital wounding three passers-by belonged to a member of the militant Palestinian group Hamas, a Palestinian official said. "He belongs to Hamas. God has saved him," said the source on condition of anonymity of the owner of the car, refusing to give any other details. "The group who carried out this act deals with Mossad, or perhaps it is Mossad itself," Interior Minister Ghazi Kanaan was quoted as saying earlier by the official SANA news agency.

REDWOOD CITY, Calif. (AP) - The jurors deciding whether Scott Peterson should be executed or spend life in prison for killing his pregnant wife reached a verdict in the trial's sentencing phase Monday, a court official said.

The decision came on the third day of deliberations and after the jury requested autopsy photos and other evidence that had been presented during the guilt phase of the trial.

After the jury broke for lunch, a court administrator told The Associated Press to "tell everyone we're having a verdict at 1:30."

Evidence consisting of circumstances which afford reasonable ground for believing in the guilt or innocence of an accused person. Circumstantial evidence is generally stated to be inadmissible according to Jewish law; but this assertion is incorrect. All evidence is more or less circumstantial, the difference between direct and circumstantial evidence being only a difference in degree. The former is more immediate, and has fewer links in the chain of connection between the premises and the conclusion than the latter.

The Mosaic law requires that every fact be proved by the testimony of two witnesses (Num. xxxv. 30; Deut. xvii. 6, xix. 15), and the Talmudic law requires that each witness testify to the whole fact, and that the witnesses shall not be permitted to supplement each other's testimony (B. Ḳ.70b). But, admitting that it requires the positive testimony of two witnesses to every material fact in the case, this does not preclude the court from drawing inferences from the facts proved; and wherever such inferences are drawn—this is necessarily done in every case at law—circumstantial evidence is to that extent recognized as legal.

In criminal law the necessity for at least two witnesses is strictly maintained (Sanh. 37b; Maimonides, "Yad," Sanhedrin, xii. 3, xx. 1).

In civil matters the testimony of one witness is in some cases sufficient to compel the party against whom the witness is produced to take the oath of purgation; and, on the other hand, the production of one witness in favor of the party absolves him from taking this oath, in cases where he would otherwise have been obliged to take it (Shebu. 32a). The law likewise recognizes certain presumptions arising from a given state of facts; although these presumptions may be rebutted by positive testimony, they establish a prima facie case without further proof (Ḳid. 80a). 35th Annual West Coast Chabad Shluchim Convention

Coming from S. Francisco, Los Angeles, S. Diego, Las Vegas, and dozens of cities in between, 150 Chabad rabbis gathered for the 35th annual West Coast Chabad Shluchim Convention at the Ontario Marr iott in January. Appropriately themed “Unity,” the Convention focused on the collective strength achieved through a unified, cohesive body of Chabad leaders, working together toward the same goal of reaching out to every person in need and creating vibrant communities throughout the West Coast.

A much-anticipated event for Chabad rabbis, the Convention provided the opportunity to exchange ideas, compare notes and socialize. The Convention also introduced major plans on the horizon. Prominent on the agenda is CAFA, or Chabad Action For America, a program that will link Chabad programs to the new White House faith-based initiatives.

Chabad rabbis also committed to working in conjunction with the Israeli government and Israeli Ministry of Tourism to travel to Israel and to encourage their communities to visit and support our Israeli brothers and sisters in a show of unity and solidarity in this most desperate time of need. The first group of Shluchim traveled to Israel in February and will be followed by similar such groups during the year.

Topping off the Convention, Chabad publicized plans to dramatically expand its services on the West Coast by establishing an additional 20 Chabad centers during the upcoming year, bringing the total number of centers serving the West Coast to 200.

‘National Menorah’ lighting marks 25th anniversary of Chanukah tradition

Rabbi Levi Shemtov was just 11 years old the first time a giant Chanukah menorah was set on Lafayette Park, across from the White House. President Jimmy Carter lit the 30-foot chanukiah, placed by American Friends of Lubavitch, dubbing it the “National Menorah.”

The year was 1979, and Lubavitch Chabad was just beginning to bring Chanukah menorahs to public places throughout the country.

“I came just as it was ending,” Shemtov remembers about that first ceremony, which was attended by fewer than 50 people. “We were with people who just came from Russia and they were flabbergasted” to see a Chanukah celebration so close to the White House.

Twenty-five years later, Shemtov, now director of the American Friends of Lubavitch’s Washington office, presided over a Chanukah lighting on Tuesday evening, this one on the Ellipse, that drew more than 1,500 spectators and a host of dignitaries.

On hand for the lighting of the first candle on the 30-foot menorah, were Secretary of the Interior Gale Norton and former Undersecretary of State Stuart Eizenstadt.

“Chanukah reminds us of the power of a single act to illuminate the world. Twenty-five years ago, this national tradition was struck by a spark set by the American Friends of Lubavitch,” Norton said Tuesday, according to Shemtov. “But tonight’s light was actually kindled more than 2,000 years ago.”

Shemtov credits Eizenstadt, then special adviser to the president, for getting Lubavitch the initial permission for the event. “If not for him, it wouldn’t have happened,” the rabbi said.

Eizenstadt recalls receiving a call from Shemtov’s father, Avraham, complaining that the Interior Department had turned down Lubavitch’s permit request to erect the menorah, on the grounds it violated the First Amendment’s clause on church-state separation.

Eizenstadt appealed to then Interior Secretary Cecil Andrus. Referring to the annual Christmas tree on the Ellipse, he remembered telling the secretary, “I don’t see how you can grant one, and not the other.”

When Andrus resisted, Eizenstadt said he told him, “If you don’t agree to this, I’m going to take this to President Carter and you’re going to lose.” Andrus ultimately issued the permit.

But the menorah was not without controversy. Some liberal Jewish groups argued that it violated church-state separation.

Battles over religious displays on public property have reached the U.S. Supreme Court. In three separate cases, the court defended the display of religious symbols, including the display of a Lubavitch menorah on government property in Cincinnati’s Fountain Square in 2002, when John Paul Stevens ruled that the city could not ban the menorah and other religious objects.

The Supreme Court is scheduled to hear arguments on the legality of displaying the Ten Commandments in public in 2005. A negative ruling on this decision could open the way for more legal challenges to the public display of religious objects, according to Michael Lieberman of the Anti-Defamation League.

Shemtov views the lighting of the national menorah as a public service, citing commendation letters on the occasion of the 25th anniversary from most of the nation’s governors.

“Religion in the public square might not be” the Lubavitch movement’s “prerogative, but the inclusion of our religion in the public square is our prerogative,” he said last week. “For people who have problems with inclusion of religion in the public square, removal of all Jewish symbols will not lead to the removal of all Christian symbols.”

Eizenstadt sees the chanukiah as a symbol of religious pluralism and evidence of “Jews being more willing to demonstrate pride in their religion.”

It also is a symbol of American governmental tolerance and respect for diversity, he said on Monday.

Those attending Tuesday’s event heard from Capt. Shmuel Leib Felvenberg, an army chaplain who spoke to the crowd by telephone from Iraq.

“His basic message was that support for the troops is really important to those serving,” Shemtov reported.

Tuesday’s celebration also included performances by a singing trio known as the “The Three Cantors,” the United States Navy Band and the Military District of Washington Band.

National Menorah Essay Contest finalists Vivian Franks and Joshua Drucker, both students at the Hebrew Day Institute in Silver Spring, read their winning essays, and the crowd was treated to latkes and jelly donuts.

“It is a mitzvah for one person to light the Chanukah menorah in a centrally dedicated display for the general public to see,” Shemtov said. “Awareness and appreciation of the miracle is maximized.”

Lubavitch issued a commemorative coin for the silver anniversary, featuring the menorah, White House and a flag on one side, an oil flask and latkes on the other.

Jury Recommends Execution for Peterson

REDWOOD CITY, Calif. (AP) - A jury decided Monday that Scott Peterson should be executed for murdering his pregnant wife, Laci, whose Christmas Eve disappearance two years ago was the opening act in a legal drama that captivated the nation.

Cheers went up outside the courtroom as the jury announced its decision after 11 1/2 hours of deliberations over three days. The jury had two options in deciding the 32-year-old former fertilizer salesman's fate: life in prison without parole or death by injection.

Judge Alfred A. Delucchi will formally sentence Peterson on Feb. 25. The judge will have the option of reducing the sentence to life, but such a move is highly unlikely.

Alfred William DeLUCCHI was born 2 Jul 1915 in Novato. He was the son of Ferdinand DeLUCCHI and Laura SOLARI. His father, who was known as "Fred", was the Novato town constable. He was well-known for giving out speeding tickets. He would wait beside the highway in his white Mercer and catch the San Franciscans speeding on their way north for the weekend. Mary UNGENASCH's book, Novato Township: Land Grants to World War II, reports that he would take the culprits to Judge RUDOLFF at the Novato French Cheese Factory (owned by the judge) where they would be fined $5 and given a box of cheese. Frank GALLI says that the Old Town section of Novato was paved with the fines that Ferdinand DeLUCCHI collected! Frank also said that Ferdinand, "literally put Novato on the map". Novato was a very small town back then and one could pass it without even noticing. But, after awhile, everybody going north knew about Novato and the speeding tickets from Ferdinand DeLUCCHI.

Jackie MOORE, a Novato historian, said that at Halloween the children used to like "to devil him". They would be up to trouble at one end of the street, attracting Ferdinand over there. Once he shooed them away, other kids would be doing things at the opposite end of the street. They would do this repeatedly. Ferdinand was a member of the Novato Masonic Club. He became a Steward of their Lodge of Instruction when it was begun in May 1923. Many remember his limp that was the result of some accident.

In arguing for death, prosecutors called Peterson "the worst kind of monster" and said he was undeserving of sympathy. The defense begged jurors to "go back there and please spare his life."

The decision came almost two years to the date after the disappearance of Laci Peterson, a 27-year-old substitute teacher who married her college sweetheart and was soon to be the proud mother of a baby boy named Conner. The story set off a tabloid frenzy as suspicion began to swirl around Scott Peterson, who claimed to have been fishing by himself on Christmas Eve and was carrying on an affair with a massage therapist at the time.

The remains of Laci and the fetus washed ashore about four months later, just a few miles from where Peterson claims to have gone fishing in San Francisco Bay. The case went to trial in June, and Peterson was convicted Nov. 12 of two counts of murder.

All the while, the case never stopped making headlines.

The case graced more People magazine covers than any murder investigation in the publication's history. Court TV thrived during the case, providing countless hours of coverage on the investigation and gavel-to-gavel commentary throughout the trial. CNN's Larry King hosted show after show with pundits picking apart legal strategies, testimony and even Scott Peterson's demeanor.

Peterson will now be sent to death row at San Quentin State Prison outside San Francisco, the infamous lockup where prisoners gaze out small cell windows overlooking the same bay where Laci Peterson's body was discarded.

Peterson still might not be executed for decades, if ever. That is because California's death row has grown to house more than 640 condemned men and women since the state brought back capital punishment in 1978. Since then, only 10 executions have been carried out. It can take years for even the first phase of the appeals process to begin.

California's last execution was on Jan. 29, 2002, when Stephen Wayne Anderson - described by supporters as the poet laureate of Death Row - was put to death by lethal injection for the Memorial Day 1980 murder of 81-year-old Elizabeth Lyman during a break-in at her home.

As many as three murderers face possible execution in 2005, said Department of Corrections spokeswoman Margot Bach.

Prosecutors spent months portraying Peterson as a monster, a cheating husband and cold-blooded killer who wooed his lover even as police searched for his missing wife. They said he wanted to murder Laci to escape marriage and fatherhood for the pleasures of the freewheeling bachelor life.

The prosecution put on a short, but emotional case in the penalty phase of the trial, calling just four witnesses.

"Every morning when I get up I cry," Laci's mother, Sharon Rocha, said during the penalty phase. "It takes me a long time just to be able to get out of the house ... I miss her. I want to know my grandson. I want Laci to be a mother. I want to hear her called mom."

Rocha would later rise halfway out of her seat and scream at Scott Peterson, who was seated impassively at the defense table: "Divorce was always an option," she said. "Not murder!"

Defense attorneys argued during the trial's guilt phase that Peterson was framed and that the real killers dumped Laci's body in the water after learning of Peterson's widely publicized alibi. The defense fought hard to save Peterson's life, calling about 40 witnesses over seven days in the penalty phase.

They seized on anything from Scott Peterson's past in attempt to spare his life, including testimony that he never cheated on the golf course or lost his temper.

They told jurors of the Scott Peterson who was a smiling, snuggling toddler. He was the high school golf captain who tutored younger students. He sang to seniors on Sundays and once broke up a dog fight. He cared for mentally retarded children. He was the highly motivated son who worked his way through college.

And finally, he was the young professional who married the woman he fell in love with in college.

"I wish there was a phrase that I could give you that could turn this around and make you believe there is good, there is real, real good in this person," defense attorney Pat Harris said during closing arguments. "But I don't have that phrase ... that's up to you to decide."

Any nation or public figure who paid their respects to Yasser Arafat was lacking either in knowledge or morals. Ellen Horowitz states that there are seven universal laws called Noahide Laws, which non-Jews are expected to observe. Arafat broke all of them.

He murdered, stole, refused to establish courts of justice, all the while turning himself into an icon. How an individual reacted to the death of Arafat is an indication of the character of that person. The ones who mourned were either ignorant or wicked, and the righteous had reason to rejoice.

We celebrated all week. Candies and cakes were being passed around, because - unlike the Arabs who distribute sweets and party over Jewish blood - we were affirming life and its miracles.

That the beast who gave terror a bad name fell critically ill while I was preparing for one son’s Bar Mitzvah, and that Arafat’s death was made official on the morning of my eldest son’s 21st birthday was just an added plus- and I am very grateful for it.

I promised myself and my family that I would do my best to switch gears and pry myself away from the international scene, national situation and Internet for a couple of weeks in order to concentrate on simchas. But every once in a while I snuck a peek at the Arafat Freak Fest via CNN.

I watched how the world media and Palestinian powers-that-be haggled over the terms of his demise like he was an item up for sale in a Baghdad bazaar. Recall how anxiously they were “preparing for his burial” while he was “still alive.” Henceforth he should be referred to as “The Knight of the Living Dead.” I guess I derived a certain satisfaction from knowing that the world and his people essentially buried him alive - a death befitting such a repugnant personality.

I watched as the bizarre farce over his illness turned into a ghoulish lament come burial time, and nobody does it better than CNN’s Christian Amanpour. But why should we be shocked by the coverage given to the scum when it is a well-established media standard that “one man’s terrorist is another man’s freedom fighter?”

In a world of shifting sands and mores, is the definition of humanity an issue of relativity, or are there still firm and consistent codes and criteria which make us definitively human and provide us with the stability and clarity that so many of us crave?

As Jews, we are commanded to keep hundreds of intricate laws, whereas non-Jews are expected to follow seven universal laws that date back to the time of Noah. The following decrees were established with the purpose of ensuring a just, peaceful and creative world:

Our tradition views those who scrupulously adhere to these Noahide laws to be
righteous individuals who are assured a place in the world to come (unlike the price of admission to the Islamic version of paradise which can be attained by immolating oneself along with others).

I suppose a minority of the folks in today’s world actually holds to the exact letter of these laws, but it’s a rare and evil bird who somehow manages to break every one of the seven edicts. Arafat was such a creature...

The following excerpt from an editorial in The Washington Times succinctly sums up his legacy of theft and murder:

“While millions of Palestinians continue to languish in squalid refugee camps throughout the region thanks in large part to his obduracy, Yasser Arafat became rich. Forbes magazine recently estimated his personal fortune at approximately $300 million - wealth accumulated largely through questionable business deals and stolen foreign aid money. Other estimates put the amount embezzled at more than $1 billion. This is the legacy of Yasser Arafat - a man who became very rich while trafficking in murder and theft and sabotaging the national aspirations of his own people.”

He is judge, prosecutor and defense counsel, and if necessary, he is above the law.”

Turning oneself into an icon or god also constitutes idolatry and Arafat was good at that. He publicly ranted the following at news correspondents:

“Do not forget you are speaking to Yassar Arafat” (Hala Jabar, London Telegraph)
“You are speaking with Yasser Arafat, you are attacking me.” (Ted Koppel, ABC Nightline)
“You are speaking with General Yasser Arafat. Be quiet!” (Christian Amanpour, CNN)

It should be noted that, for the most part, the press enjoyed the abuse - they lapped it up and begged for more.

Rule number two commands us not to blaspheme God. Arafat was a walking desecration - a sacrilege of everything right and good. His complete contempt for human life constituted total denial of God and was in itself definitive blasphemy.

Any nation, leader, diplomat or news commentator who felt it necessary to pay their respects to an utter abomination had best pause for thought and look where and on whose blood they are standing and tremble. Those who were able discern the evil in Arafat and avoid contact with him and those like him, at all costs, have reason to rejoice

As for the Netziv’s appealing to Shvu’os 35b which derives from Shir Hashirim 8:12 that a monarch may kill up to a sixth of the world’s population in the course of military exercises with impunity, a two-tier refutation may be advanced. Firstly, the said scriptural verse is actually subject to two mutually exclusive talmudic interpretations, only one of which offers a sovereign the license to slay. The identity of the exegesis to be accepted as normative is disputed by the Ran and Rambam. Secondly, even if the halakha is assumed to follow the Ran, the empowered sovereign in question may refer exclusively (as Tosafos apparently understand) to a Jewish king who receives prior authorization to wage war by means of the Urim Vetumim’s prophetic revelation, in contradistinction to a normal Noahide king who acts on the basis of his own human impulses. In any event, the fratricidal pleonasm of Genesis 9:5 on which the Netziv bases his permission can be satisfactorily explained in an entirely different manner, viz., R’ Jacob Tzvi Mecklenburg’s elucidation (in the latter’s Hakesav Vihakabbala) that it introduces a prohibition against euthanasia. Maharal’s proof from the attack on Nablusmay be deflected by citing the commentaries of Maimonides and Nachmanides who maintain that the entire population of Nablus legally deserved execution because of outstanding capital offenses it had already committed. If that is so, then no lesson for posterity can be derived from Shimon and Levi’s exceptional behaviour.

The result of WW2 brought another step forward in the Redemption of Israel – the establishment of Jewish State.

G-d directs the world in a natural, historical fashion, achieving His aims through the vehicle of nations and kings. Sharif Omar has been waiting two years for the bulldozers, ever since Israel's steel and barbed wire "security fence" carved its way between his village and its land. Last week the excavators and diggers finally arrived on the outskirts of Jayyous to lay the foundations for an expansion of the nearby Jewish settlement of Zufim, fulfilling the fears and warnings of its Palestinian neighbours.

 

The bulldozers were preparing the ground for hundreds of new homes, despite the Israeli government's claim that it is not expanding Jewish settlements in the West Bank. Like other building work along the route of the barrier, it seems to be an attempt to ensure that the land between the fence and the 1967 border remains in Israeli hands in any final agreement with the Palestinians.

 

"When they built the fence, we said they would use it to build a much bigger settlement, and they would take our land to do it," said Mr Omar, whose olive and citrus groves are now encircled. "It is very clear to us, they are planning to confiscate all of our land and drive us from here. They came and told us to finish harvesting because they were going to begin building 80 houses. They are beginning with my neighbour's land but if they do it there they will do it on mine."

 

At least five other sites along the barrier have settlement work in progress. Israeli human rights groups say the government appears to be racing to fill in the gap between the barrier and the Israeli border before a US team arrives next year to mark out the final limits of settlement expansion.

 

Zufim, where about 200 families live, is built on 136 hectares (336 acres) of land confiscated from Jayyous in 1986. An Israeli rights group, Bimkom, says that developers in Zufim plan to build about 1,200 new homes. Yehezkel Lein, a researcher for another Israeli human rights group, B'Tselem, said the military government in the occupied territories had issued permits for the work.

 

He added: "In the plan for Zufim there is an extension to the north of the settlement that was already approved. There is also another expansion to the east. But there is no territorial contiguity between Zufim and the new construction, so it is really a new settlement."

 

He said the government's intention became clear when it sited the barrier between Jayyous and Zufim so that most of the land was on the settlers' side. "The fence took an inconvenient route, not one that is best for security. If you ask why, it can only be to take the land."

 

About 400 more houses are being built around Alfe Menashe settlement, at the heart of an enclave created by a loop in the barrier less than two miles south of Zufim. Trapped inside are five smaller Palestinian communities of about 1,000 people and their land.

 

A short distance away work has begun on about 50 houses at Nof Sharon on land confiscated from a Palestinian town. In recent months the government has invited tenders to build thousands of houses in big settlements, such as Ariel, and those close to Jerusalem, including Ma'ale Adumim.

 

The first stage of the peace road map obliges Israel to freeze all settlement construction. Its foreign minister, Silvan Shalom, told the British foreign secretary, Jack Straw, in Jerusalem last month that the government was not expanding its settlements.

 

But a foreign ministry spokesman, Mark Regev, said yesterday that Israel had an agreement with the US that new building was allowed within existing built-up areas. "The word settlement expansion means the outward growth of settlements. From our interpretation, that means building inside existing settlements," he said.

 

Pressed on why the building near Zufim and other sites was some distance from the settlements, Mr Regev said there was a different view of Jewish colonies close to the 1967 border. "We are talking about places that it's accepted will remain inside Israel whatever the outcome of final status talks. It's possible that in those places the thinking is different."

 

The Palestinians say there is no such acceptance on their part, and this is an Israeli interpretation of an agreement with Washington.

 

Settlement expansion between the barrier and the green line has been encouraged by a letter from President Bush to Ariel Sharon in April promising that "population concentrations" in the occupied territories - taken to mean Jewish settlements - would remain in Israeli hands under any peace agreement with the Palestinians.

 

Last week the US national security council adviser on the Middle East, Elliott Abrams, told a closed meeting of Jewish leaders that Washington saw settlements to the east of the barrier as ultimately intended for removal. But he said Israel would be allowed to hold on those to the west, which include Zufim.

 

The Palestinian communities trapped in the enclave with Alfe Menashe have gone to the Israeli high court to get the barrier moved, in part because they are afraid that settlement expansion will grab more of their land.

 

Last week government lawyers told the court that living next to Alfe Menashe gave the Palestinians the opportunity to find jobs in the settlement, and so they "were not only not harmed by building the fence but even benefited from it".

 

The villagers' lawyer, Michael Sefarad, was astonished by the government's claim. "None of the enclave's residents wants the fence, and is not interested in being at the mercy of the settlers. To suggest that is outrageous," he said.

 

"It reveals how the justice ministry really regards the Palestinians' lives and wishes. If anyone can even think that a Palestinian would be happy to live in a walled-in enclave because it gives him the opportunity to work in a settlement, it is very sad."

A group of right-wing Jewish activists reenacted a religious ritual from the First Temple period at the Shiloah Spring in the east Jerusalem neighborhood of Silwan Tuesday night, with the goal of removing Prime Minister Ariel Sharon from power and instituting a Jewish monarchy.

With shofars blasting in the background, the group – led by Prof. Hillel Weiss, a well-known Temple Mount activist and a lecturer on literature at Bar-Ilan University, and Rabbi Yosef Dayan, who recently threatened to instigate a death curse against Sharon – conducted the nisuah hamayim ritual, which they said "will begin the process of removing the secular Israeli government."

"This ceremony will lay the foundations for instituting a Jewish king, a Jewish court, and the Third Temple," Weiss told the 40 participants sitting near the Shiloah Spring. Standing next to the running water, said to also be used in Temple times to spiritually cleanse the high priest during the Yom Kippur services, Dayan blew the shofar while Weiss collected holy water.

"The purpose of the ceremony is to remove the current government, and in order to do so we need to draw strength from the pools of salvation," Weiss said. "If we want to make a revolution, then we need to change the course of the winds blowing among the people."

Weiss, who recently published a book calling for the institution of a Jewish monarchy in the State of Israel, refrained from spelling out how he intends to "remove Sharon," but did say that the "religious powers will grant us the strength to do so."

The nisuah hamayim ritual finds its source in the Mishna. During Succot in the time of the Temple, the priests would gather water from the holy Shiloah Spring and would pour it onto the tabernacle in the Temple, accompanied by songs and trumpets. The religious meaning behind the ritual, Weiss said, was to draw strength and spiritual powers from the water, which would then sustain the priests throughout the year.

Last month, Attorney-General Menahem Mazuz decided not to launch a criminal investigation against Dayan, who had said that he would be prepared to instigate a death curse against Sharon. Mazuz arrived at his decision after an examination of the comments made by Dayan and the conclusion that they did not contain a basis for criminal charges of incitement to violence.

"I definitely want something bad to happen to Sharon so that he will cease doing whatever it is he does," Dayan said on the eve of Rosh Hashana. "Nobody has called on me. A person can pray to the heavens on any subject he wishes."
