The 'process' began with the Nixon Whitehouse and the Asst. Attorneys, in the Attorney Generals Office, under that Administration. One of these, by the name of Rehnquist, was 'rewarded' for his participation, with a job in our United States Supreme Courthouse. It was then that the Department of Justice was ordered, and eagerly complied, with a request very similar to that which John Ashcroft acted in Contempt of Congress to conceal. The objective was to place Nixon, and all others in the Executive Branch of Government, 'Above the Law', with an argument of 'Official Immunity'.

 

For the past 35 years 'America' has been systematically, quietly, 'redefined'. They did not succeed but some of the same people involved in this were then given positions where they could implement this as 'Law' through dicta from our judicial Branch. The 'redefinition' abolished our most important Constitutional protection. The 'Prohibition of Titles of Nobility', established in Article I, sections 9 & 10. The 'immunity' doctrine grants 'Nobility status to ALL who are employed, and collectively make up, our government(s).

 

The most recent excuse for this 'redefinition' came on September 11, 2001. People have short memories but I remember, with horror, the frequent reference to 'America Redefined'. One network even adopted this as the Title of their News Program for the year following. The result is an Administration, and government, that acts with impunity. 'They' are not 'under Law'. They, in their minds, ARE 'the law'.

 

Few Americans today know the definition of America. It is found in our Constitution but ONLY if one realizes our Constitution was established to 'Secure the Blessings of Liberty' that blood was shed to secure. The definition of 'Liberty', and therefore what became the United States of America, is what I call 'Americanism' or, in other words, the definition of America as a Nation of People. It is the common characteristic that defines us as a Nation. It is what established our Government as a Government under the Rule of Law and clearly makes a distinction between our Government and our Nation. They are NOT one-in-the-same. Becoming aware of this distinction there is, then, no doubt that the Government under our current administration is a ROGUE government.

 

The definition of Americanism, and America as a Nation of People known as the United States, or by the nick names of 'Americans' in the Land known as America, is found in our Declaration of Law more commonly known as the Unanimous Declaration of Independence of the United States of America;

 

We hold these Truths to be self-evident (meaning they must be taken as Fact in this Land)

 

1 - All men (Human Beings) are created equal. (this includes ALL of humanity, along with those who live, or may be found, in Iraq or Afghanistan)

 

2 - Endowed (entitled) by their Creator, to certain inalienable (inherent) Rights, (Human Rights as well as the Civil found in Constitutions and International Law)

 

3 - That among these are Life, Liberty, and the Pursuit of Happiness ('among these' means 'not limited to'. Purpose of Government and Law is to find, and make more 'certain' other Rights of the Individual Human Being)

 

4 - TO SECURE THESE RIGHTS, governments are instituted among men by consent of the governed.

 

NOTE: Number 4 is what separates 'We the People' from our Government and makes our Government Accountable to our Constitution by which LIMITED powers are delegated. A Government that is NOT 'the Law' but 'subject to' the Law.

 

It is now called the 'Age of Terrorism', as a replacement for the 'America Redefined' phrase, is just the final nail in the coffin of a death that began with the quiet, subtle, reversal of the glorious Civil Rights movement of the 1960's with a Judiciary intent on overthrowing our government 'of the people, by the people, and for the people', with the aid of Attorneys who play word games to exempt a few from any accountability to any law of God or of Man.

 

'We the People' are now the 'enemy combatant', by their definition. 'We the People' are the 'threat of terrorism' that justifies any and all 'pre-emptive' strike, with a license to invade our privacy, our homes, and even torture us. No 'nationality', including those of us who are of American nationality, is protected. This is why it is so extremely distressing to me to hear some of my fellow Americans dismiss, or attempt to justify, the torture of Iraqis or any other Individual Human Being of any Nationality or caught outside the borders of their homeland. 'We the People' in and of America, are just as much at risk, and maybe more at risk, of being subjected to the same treatment inflicted on those held in Guantanamo or Abu Ghrab, as our Government has turned against ALL of us who are not part of It.

 

Those that give up essential Liberties for the mere appearance of safety, will lose both Liberty and Safety. It is a MYTH that Liberty and Security are Mutually Exclusive. In fact; you cannot have one without the other.

 

I speak from real world experience as one who has attempted to hold criminals and terrorists, hiding in our government in positions of public trust, accountable to the law. Our 'protectors', the Attorney General and his Office for the State of Texas, and the Department of Justice, will stop at nothing to protect them with free legal services at the expense of our Nation's Treasury. Even after attaining several judgments on the Law and on the Facts, by some judicial Officials, acknowledging the acts were criminal and terroristic, (committed while Bush was Governor here) they continue to Obstruct Justice for those they consider 'Nobles' by title of employment by election, selection, or appointment to a position in government.

While activists and politicians work to repeal or change parts of the Patriot Act that they say violate constitutional rights, Patriot Act II legislation -- which caused a stir when it came to light last year -- is rearing its head again in a new bill making its way through Congress.

 

The bill would strengthen laws that let the FBI demand that businesses hand over confidential records about patrons by assigning stiff penalties (up to five years in prison) to anyone who discloses that the FBI made the demand. The bill would also let the FBI compel businesses to cooperate with record requests, and it would expand the government's secret surveillance powers over noncitizens in the United States.

 

"There is no reason for this legislation," said lawyer Chip Pitts, head of the Bill of Rights Defense Committee of Dallas and a former constitutional law professor. "Given the expanse of powers and secrecy already granted in the Patriot Act, and given the unclear security benefits and possible security detriments of that legislation, why do we need a further amendment of the law to grant more powers to the government?"

 

The bill, known as the Anti-Terrorism Intelligence Tools Improvement Act of 2003, or HR 3179, was introduced last September by Rep. James Sensenbrenner (R-Wisconsin) and was co-sponsored by Rep. Porter Goss (R-Florida), chairman of the House Intelligence Committee and a possible contender to replace departing CIA chief George Tenet.

 

It contains four sections that first appeared in a proposed piece of legislation dubbed Patriot Act II. That proposed law was discovered last year by the Center for Public Integrity just weeks before the invasion of Iraq. Patriot Act II, or "Son of Patriot" as critics called it, was written by the Justice Department to expand Patriot Act powers, but the department was forced to shelve the proposal after news of it created an uproar.

But critics, like conservative former Rep. Bob Barr (R-Georgia), say that rather than abandoning the legislation altogether, the department has been extracting provisions and having sympathetic lawmakers slip them one by one into new bills to pass the legislation piecemeal. At least five other bills pending in Congress also contain provisions from Patriot Act II, but HR 3179 is the one that's in imminent danger of being passed under the radar.

 

Last year, a Patriot Act II provision was slipped into the Intelligence Authorization Act of 2004 at the last minute and passed quickly before legislators opposed to it had time to fully examine it. The Intelligence Authorization Act, an annual bill that allocates funds for intelligence agencies, is a must-pass bill that generally gets drafted and passed quickly in secrecy.

 

The new bill, HR 3179, was set to pass through Congress without a hearing last year, but the House Judiciary Committee, chaired by Sensenbrenner, changed its mind and held a hearing May 18. The bill is waiting for markup in that committee, but critics fear that Rep. Goss and the House Intelligence Committee will slip the bill into this year's Intelligence Authorization Act during a closed-door hearing on June 16, and pass it quickly before lawmakers can revise or further debate it.

 

Proponents of HR 3179 say critics are overreacting to the bill. They say the bill will simply "plug a few gaps" in the Patriot Act by establishing penalties for noncompliance that were never specified in the Patriot Act.

But opponents say the bill grants the government more power to investigate people without probable cause and to do so under a cloak of secrecy. As a result, individuals being investigated will have no chance to protest unconstitutional searches and seizures.

 

No Due Process of the Constitution FOR the United States

 

Under the Patriot Act and Patriot Act II provisions passed in the Intelligence Authorization Act last year, the FBI doesn't need a court order or probable cause to obtain the transaction records for patrons of libraries, Internet service providers, telephone companies, casinos, travel agents, jewelers, car dealers or other businesses.

 

The FBI can simply draft a "national security letter" stating records are needed for a national security investigation, without being specific about the data being sought or the people being investigated. A nondisclosure provision prevents the letter recipient from telling anyone about it, including patrons whose records may be investigated.

Under HR 3179, anyone who knowingly violates the secrecy clause could be imprisoned for up to a year, and anyone who violates it with "the intent to obstruct an investigation or judicial proceeding" could be imprisoned up to five years. The bill also lets authorities force individuals and companies to comply with security letters under contempt-of-court threats.

 

Jeff Lungren, spokesman for the House Judiciary Committee where the bill currently resides, said HR 3179 simply gives teeth to the Patriot Act.

"Right now you can't disclose if you receive a national security letter," he said. "But if you do disclose it, there is no penalty for that. There's (also) no stick to deal with a person that refuses to comply with a national security letter."

 

But Jim Dempsey, director of the Center for Democracy and Technology, said the bill tips the balance of power further into government hands while hampering the ability of people "to push back" and provide balance to government powers.

 

No grievance

 

Currently, if government investigators request data that is too broad or intrusive, a company has some wiggle room to protect patrons' Fourth Amendment rights by resisting and negotiating a more targeted search, Dempsey said. But letting the FBI force cooperation while at the same time demanding secrecy and threatening imprisonment would make it unlikely that unreasonable secretive searches would ever be prevented or challenged.

Dempsey said he believes the original Patriot Act didn't specify penalties for disclosure because lawmakers were ambivalent about the act's powers and didn't want to eliminate opportunities for checks and balances.

Steve Lilienthal, director of the Center for Privacy and Technology Policy at the conservative Free Congress Foundation, said the gag rule is 

"a license for abuse."

 

"You have the right to talk to an attorney, but the attorney cannot talk to anyone else," he said. "You're prevented from going to the Department of Justice to communicate, or to the relevant congressional community to tell them when an abuse has taken place. It's almost un-American."

 

In addition to penalties for disclosure, HR 3179 expands surveillance of noncitizens by amending the Foreign Intelligence Surveillance Act of 1978, or FISA. Currently FISA investigations involve individuals or groups acting on behalf of a foreign government or terrorist organization. But HR 3179 would let the government conduct secret domestic surveillance against noncitizens believed to be engaged in international terrorism, but who have no known affiliation with a foreign government or terrorist group.

 

Pitts, the attorney with the Bill of Rights Defense Committee, said the amendment could be used to justify surveillance of noncitizens for criminal activity, for work with organizations like Amnesty International or for donating money to an environmental organization that stages protests.

 

"Because there is no accepted definition of international terrorism, and because they're eliminating the need for someone to be acting on behalf of a foreign government, you're relying on subjective and perhaps arbitrary or politically motivated definitions" to determine who could be secretly investigated, he said.

 

Barr, a member of the American Conservative Union who has been practicing law since leaving Congress last year, testified against the bill during the May hearing and said that Congress should not be passing new laws to strengthen the Patriot Act while there are concerns about how the legislation has been used to date. The FBI has admitted using the Patriot Act for nonterrorism investigations, such as cases involving corruption in a Las Vegas strip club, drug trafficking and other criminal activity.

 

Barr said the surveillance powers of the Patriot Act play "fast and loose" with the Constitution and that the secrecy penalties in HR 3179 would make its assault on the Fourth Amendment even worse.

 

"If the government is able to conduct its powers in secret, then we never know the extent to which its power is being used or being abused," he said. "If the government wants to conduct more of its business in secret and without probable cause, then (we should) just amend or repeal the Fourth Amendment, not allow the government to eat away at it in small steps and pretend it's still there."

 

Barr said the law should allow recipients of national security letters the right to challenge them, just as they can challenge grand jury subpoenas.

 

The American Civil Liberties Union recently discovered just how daunting the secrecy provisions can be when it was forced to file a lawsuit in secret that challenged the constitutionality of national security letters under the First Amendment. The organization was able to reveal the existence of the lawsuit only after negotiating with the government about what it could say about the suit.

 

The lawsuit was filed after the ACLU filed a Freedom of Information Act request for information about how often and in what cases authorities have used national security letters to date, and the organization received six pages of blacked-out documents.

 

Pitts said that although HR 3179 is not yet on the radar screen of most congress members, activists are working to thwart what he calls a "stealth measure."

 

"The last time (a Patriot Act II provision) slipped through and got signed was on the day of Saddam Hussein's capture," Pitts said. "There was not a single activist who knew it was coming down the pike. At least this time we know about it in advance."

 

In total, six bills pending in Congress contain provisions taken from Patriot Act II. In addition to HR 3179, three other House bills (and two Senate companion bills) were introduced late last year:

I have never contacted the FBI before for any reason, and would not have if I were not convinced that at least one FBI agent there was honest. That's you.

 

I was shocked and distressed by the attitude of the FBI leadership to your work prior to 9/11 and was completely supportive of your Woman of the Year award.

 

Because of your willingness to work towards accountability in the FBI, I have chosen to bring you this analysis.

 

The basic premise is that Israeli nationals, recently busted all around the country, are part of a possible attack on the United States, perhaps even involving nuclear weapons or an attack on nuclear facilities.

 

To say such a thing is considered political suicide, given the power of the Israeli lobby, but perhaps you will be willing to at least look at the below published news reports and documents.

Altogether, I think that the QUANTITY of Israeli nationals busted spying and or possibly moving explosives (of the 120 Israeli nationals deported prior to 9/11, most were expert in explosives or signals intelligence (check DEA/FBI report for confirmation of that) prior to and after 9/11 warrants a thorough investigation and interdiction if possible. Especially given the high-level Israeli infiltration of the US civilian and military command.

 

God knows I hope I'm wrong, I hope this summer will be uneventful, but when you have the amount of context I have and the incidents keep getting more and more frequent and alarming, this citizen feels like he has to DO something. I have contacted sympathetic members of the armed forces, and now you at FBI. I will continue to contact officials with the ability to DO something about this and hope that you can recommend others who might be sympathetic. FBI seeking 6 men seen in Midwest

WASHINGTON -- As the nation stands on high alert, the FBI is searching for six men stopped by police in the Midwest last weekend but released -- even though they possessed photos and descriptions of a nuclear power plant in Florida and the Trans- Alaska pipeline, a senior law enforcement official said Tuesday.

 

The Federal Aviation Administration imposed new flight restrictions around nuclear plants nationwide Tuesday, and the Nuclear Regulatory Commission advised the nation's 103 nuclear plants late Monday to fortify security. On Tuesday, agency spokesmen said the FAA's flight restrictions and the Nuclear Regulatory Commission's security recommendations were based on Ashcroft's general alert rather than a specific threat. Ashcroft warned that Americans could be struck by another terrorist attack this week.

 

The incident in the Midwest apparently contributed to the new warning. The six men stopped by police were traveling in groups of three in two white sedans, said a senior law enforcement official, who requested anonymity.

 

SUSPICIOUS MATERIAL

 

In addition to the photographs and other suspicious material, they carried "box cutters and other equipment,'' the official said. They appeared to be from the Middle East and held Israeli passports. They were let go after the Immigration and Naturalization Service determined that the passports were valid and that the men had entered the United States legally, the official said.

 

The FBI declined to comment. An INS spokesman called the report unfounded. "We have absolutely no information at this point in time to substantiate that story,'' said the agency's Russ Bergeron. It could not be learned in what state the six men were stopped or how they aroused suspicion. It was not known whether their true identities matched those on the passports, or why the FBI was not releasing their names or descriptions.

 

Investigators think the men almost certainly have changed cars by now and have fled to Canada or elsewhere. Ashcroft and FBI Director Robert Mueller were ``furious'' that the INS allowed the men to be released without consulting the FBI, the official said. Ashcroft and Mueller appeared Monday evening at a news conference to announce that the government had ``credible'' but vague information that another wave of terrorist attacks could strike Americans within a week.

 

ON ALERT

 

Spokeswoman Rachel Scott said FPL's plants remained at the highest level of alert. "We are in very close communication with all levels of law enforcement, including the FBI, to ensure we have the security measures in place to protect the plants,'' she said. Also Tuesday, the FAA restricted all flights below 18,000 feet and within 10 miles of 86 "sensitive nuclear sites'' , the agency said. Exceptions can be made for law enforcement, medical and firefighting flights. The 800-mile-long Trans-Alaska Pipeline runs from Prudhoe Bay on the Arctic Ocean to Valdez on the Pacific.

AUSTIN, Texas - When, in the future, you find yourself wondering, "Whatever happened to the Constitution?" you will want to go back and look at June 8, 2004. That was the day the attorney general of the United States - a.k.a. "the nation's top law enforcement officer" - refused to provide the Senate Judiciary Committee with his department's memos concerning torture.

 

In order to justify torture, these memos declare that the president is bound by neither U.S. law nor international treaties. We have put ourselves on the same moral level as Saddam Hussein, the only difference being quantity. Quite literally, the president may as well wear a crown - forget that "no man is above the law" jazz. We used to talk about "the imperial presidency" under Nixon, but this is the real thing.

 

The Pentagon's legal staff concurred in this incredible conclusion. In a report printed by The Wall Street Journal, "Bush administration lawyers contended last year that the president wasn't bound by laws prohibiting torture and that government agents who might torture prisoners at his direction couldn't be prosecuted by the Justice Department. ...

 

"The report outlined U.S. laws and international treaties forbidding torture, and why those restrictions might be overcome by national security considerations or legal technicalities."

 

The report was complied by a group appointed by Department of Defense General Counsel William J. Haynes II, who has since been nominated by Bush for the federal appellate bench. "Air Force General Counsel Mary Walker headed the group, which comprised top civilian and uniformed lawyers from each military branch and consulted with the Justice Department, the Joint Chiefs of Staff, the Defense Intelligence Agency and other intelligence agencies. It isn't known if President Bush has ever seen the report."

 

When members of the Senate Judiciary Committee questioned Ashcroft about his department's input, he simply refused to provide the memos, without offering any legal rationale. He said President Bush had "made no order that would require or direct the violation" of laws or treaties. His explanation was that the United States is at war. "You know I condemn torture," he told Sen. Joe Biden. "I don't think it's productive, let alone justified."

 

But another memo written by former Assistant Attorney General Jay S. Bybee, now a federal appeals court judge in California, establishes a basis for the use of torture for senior Al Qaeda operatives in custody of the CIA. I am not one to leap to conclusions, but it seems quite clear how whatever perverted standards allowed at Guantanamo Bay jumped across the water to Abu Ghraib prison. Maj. Gen. Geoffrey D. Miller, commander at Gitmo, was dispatched last August to Abu Ghraib to give advice about how to get information out of prisoners. "Miller's recommendations prompted a shift in the interrogation and detention procedures there. Military intelligence officers were given greater authority in the prison, and military police guards were asked to help gather information about the detainees," according to The New York Times.

 

Among the legal memos that circulated within the administration in 2002, one is by White House counsel Alberto Gonzalez, famously declaring the Geneva Convention "quaint," and another from the CIA asked for an explicit understanding that the administration's public pledge to abide by the spirit of the Geneva Convention did not apply to its operatives. The only department consistently opposing these legal "arguments" was State. In April 2002, Secretary Rumsfeld sent a memo to Gen. James T. Hill outlining 24 permitted interrogation techniques, four of which were considered so stressful as to require Rumsfeld's explicit approval before they were used.

 

 

It has been apparent for some time that the abuses at Abu Ghraib were not isolated instances - torture from Afghanistan to Gitmo to Iraq has so far resulted in 25 deaths now under investigation. As the late Jacabo Timmermann, the Argentine journalist who was tortured during "the dirty war," said, "When you are being tortured, it doesn't really matter to you if your torturers are authoritarian or totalitarian." I doubt it helps any if they're supposed to be bringing democracy, either. And as Ashcroft said, it isn't productive.

 

The damage is incalculable. When America puts out its annual report on human rights abuses, we will be a laughingstock. I suggest a special commission headed by Sen. John McCain to dig out everyone responsible, root and branch. If the lawyers don't cooperate, perhaps we should try stripping them, anally raping them and dunking their heads under water until they think they're drowning, and see if that helps.

 

And I think it is time for citizens to take some responsibility, as well. Is this what we have come to? Is this what we want our government to do for us? Oh and by way, to my fellow political reporters who keep repeating that Bush is having a wonderful week: Why don't you think about what you stand for?

The founder of Chabad-Lubavitch was Rabbi Shneur Zalman of Liady, whose somewhat uncharitable doctrine that all gentiles are "completely evil," sub-human garbage ("supernal refuse"), who possess "no redeeming characteristics," is still imparted to students in Chabad-Lubavitch schools (many of these children are named "Zalman" in his honor).

In his old age, Rabbi Schneerson, did nothing to discourage the delusion that he was the Messiah. Even after Schneerson's death in 1994, many of his followers continue to claim that either he will rise from the dead or that he is in fact, still alive: "We believe that he is alive and well, and has only `disappeared' temporarily, and that he will reveal himself at any moment." --Rabbi Zimroni Tzik.

Who was and is not and yet will be?

According to Prof. David Berger, a lecturer in Jewish studies at Brooklyn College and at the Graduate Center of the City University of New York, "the messianists are no longer satisfied with identifying the rebbe (Schneerson) as the Messiah, but identify him as God himself."

By proclamation, in 1983, President Reagan established the birthday of this false messiah and "god", Schneerson, (March 28), as "Education Day USA" (it has been observed on various days in the spring, including March 26, April 2 and once on Hitler's birthday, April 20; see http://www.reagan.utexas.edu/resource/speeches/1986/41986b.htm).

The ominous law which grew out of Reagan's repeated proclamations in Schneerson's name, Public Law 102-14, establishes a statutory obligation on Americans to obey the Talmudic interpretation of the "Noahide Laws" (a counterfeit name, since rabbinic tradition disparages Noah), which stipulate the death penalty for "avoda zara" (idol worship), of which, according to the halachic authority Maimonides, all who worship Jesus Christ, are guilty. So we have, thanks to Mr. Reagan, a law on the Federal statute books, which can be invoked at any time to establish legal grounds for executing those who worship Jesus as the second person of the Holy Trinity.

There is no TRINITY of GODS, this is where Hoffman is either in err or he too is disinformation. 4. On November 3, 1983, Reagan signed the law establishing the third Monday of every January as the Martin Luther King, Jr. National Holiday. This law has nothing to do with the advancement of the civil rights of black people, who were saddled with a paralyzing welfare entitlement mentality commensurate with the rise of King, and who had been far better served by the empowering self-reliance creed of the now largely forgotten black educator, Booker T. Washington.

Reagan knew fully well, as he affirmed to New Hampshire Governor Meldrim Thompson, that Martin Luther King was a serial adulterer, plagiarist (having cheated on his PhD. dissertation at Boston College) and Communist party affiliate. "I have the reservations you have," Reagan wrote Thompson, "but here the perception of too many people is based on an image, not reality."

With a monumental shrug of his broad shoulders, Reagan knowingly committed one of the most treacherous acts of compromise of any president in our nation's history, signing into law the King holiday. By so doing, Mr. Reagan sentenced American children in public schools across the land to an immersion every January in King's crippling philosophy of entitlement, with its undercurrent of contempt for poor whites, whose ancestors were themselves slaves in 17th and 18th century America (not just "indentured servants").

With the exception of Abraham Lincoln, no American is studied in our public schools with the fervor and to the extent accorded Martin Luther King, not even our nation's founder, George Washington, who has been relegated mostly to serving as an icon of February clearance sales in advertisements for used cars and furniture.

King dedicated himself to overthrowing our immemorial rights to free association (i.e. the right to choose your employees and the customers you will serve in your business), and the right of private property (the right to decide to whom you will sell or rent your property). He succeeded when these rights were derogated by the misnamed Civil Rights Act of 1964. Imposing, by Federal fiat, a national holiday honoring King, institutionalizes the moral, ethical and legal rectitude of the assault on these rights.

Due to King and his enabler Reagan, we have raised a generation of American judges, legislators and students with no grasp of the necessity of these vital rights, and no memory of their hallowed, thousand year legacy. Instead, we now have millions of Americans too terrified of Federal enforcement agents to dare to hire or rent to those whom they most desire to employ or house. This represents a grievous abridgment of the civil rights of all Americans.

5. After his reelection in 1984, Reagan began to press for the acquisition of a vast pool of coolie labor on behalf of his corporate patrons, due to the fact that most native-born Americans in that era insisted on a living wage, according to the ancient standard of the Church (I Timothy 5:18).

In order to lay the groundwork for the transformation of yeoman America into a cheap labor colony, Reagan championed a controversial amnesty scheme for millions of illegal aliens, most of whom were Mexican nationals. In 1986, Reagan triumphed, signing into law the Simpson-Mazzoli Act, granting the amnesty which almost immediately led to an unprecedented immigration invasion which has not abated to this day, and which in turn created vast financial burdens on California's medical insurance program; and the inflation of housing costs to unbearable levels, (causing many native-born Americans to be unable to afford a home in California). The American southwest has subsequently been transformed into a crime-ridden outpost of a resurgent "Aztlan." President George W. Bush has proposed another calamitous, Reagan-style amnesty for illegal aliens on the same grounds and for the benefit of the same traitorous, Antichrist, predatory capitalist interests.

Ronald Reagan's foreign policy supported and maintained in power many of the protagonists in the Muslim and Arab world who have lately been branded as planetary threats to world peace, including Saddam Hussein, Reagan's ally in the Iraqi-precipitated Iran-Iraq war, and Usama bin Laden, who was armed and funded by Reagan's CIA in Afghanistan.

Reagan is alleged to be a redoubtable "Commie fighter." This risible PR spin overlooks the historic role the US government has played in ensuring the survival and expansion of the Communist slave system (in Russia by Henry Ford and Franklin D. Roosevelt; in Eastern Europe by Roosevelt and Harry S. Truman, and in China by George C. Marshall and Richard M. Nixon).

Communism only becomes vulnerable to destabilization by the US when it exhibits two defects: falling out of favor with the International Trade Cartel (Cuba) or falling out of favor with International Zionism (the USSR). Both Democrat Lyndon B. Johnson in the late 1960s and Republican Nixon in the early 1970s did ample business with the Soviet Union in ways that significantly bolstered the Soviet system.

It was only after a clear consensus emerged in New York, London and Jerusalem that the Judaics were scheduled to at long last terminate their world-historic Communist operations in Russia, and transform themselves into "victims of Communism," that Reagan was given the green light to play liberator. Yet at the same time our hero was acting this part, his Office of Special Investigations (OSI), a Federal agency which functions as an enforcement arm of international Zionism, was kidnapping elderly anti-Communist Christians and shamefully and disgracefully handing them over to the Communist butchers they had once fought. Most notorious in this regard was the Reagan administration's monstrous betrayal of the Catholic Croatian statesman Andrija Artukovic, an octogenarian who was keelhauled on a hospital gurney back to Communist Yugolslavia in 1986, to the hideous glee of vengeful Judeo-Communists.

It is patent that on those occasions when his Judaic handlers sought to have him assist vicious Communist persecution, Reagan timidly obeyed his orders and collaborated; and in those geo-political situations, such as in Russia, where, after 70 years on the road to nowhere, the Russian nation had been raped and drained to the point of collapse, and it was time for the Holy People to head for greener pastures in Brooklyn, Beverly Hills and Tel Aviv, that Reagan was allowed to step in, on cue, and assume the mantle of "Liberator of The Evil Empire."

Amid the sawdust of the American funhouse carnival, in the double-mind of the split-personalities who people that funhouse, Ronald Wilson Reagan is a paradigm of "the good and the true" in a "world of venal compromise."     The document is titled 'Standards of Conduct for Interrogation under U.S.C. 2340-2340A.' It is a memo dated August 1, 2002, and was written at the specific request of Alberto R. Gonzales, Counsel to the President of the United States of America.

    U.S.C. 2340, one of two sections of the U.S. Code referred to in the August 1 memo, reads as follows:

(1) "torture" means an act committed by a person acting under the color of law specifically intended to inflict severe physical or mental pain or suffering (other than pain or suffering incidental to lawful sanctions) upon another person within his custody or physical control;
(2) "severe mental pain or suffering" means the prolonged mental harm caused by or resulting from -

(a) the intentional infliction or threatened infliction of severe physical pain or suffering;
(b) the administration or application, or threatened administration or application, of mind-altering substances or other procedures calculated to disrupt profoundly the senses or the personality;
(c) the threat of imminent death; or
(d) the threat that another person will imminently be subjected to death, severe physical pain or suffering, or the administration or application of mind-altering substances or other procedures calculated to disrupt profoundly the senses or personality.

    U.S.C. 2340A reads as follows:

(a) Offense. - Whoever outside the United States commits or attempts to commit torture shall be fined under this title or imprisoned not more than 20 years, or both, and if death results to any person from conduct prohibited by this subsection, shall be punished by death or imprisoned for any term of years or for life.
(b) Jurisdiction. - There is jurisdiction over the activity prohibited in subsection A if -

 

(1) the alleged offender is a national of the United States; or
(2) the alleged offender is present in the United States, irrespective of the nationality of the victim or alleged offender.

    The first paragraph of the August 1 memo to Gonzales reads as follows:

We conclude below that Section 2340A proscribes acts inflicting, and that are specifically intended to inflict, severe pain or suffering, whether mental or physical. Those acts must be of an extreme nature to rise to the level of torture within the meaning of Section 2340A and the Convention. We further conclude that certain acts may be cruel, inhuman or degrading but still not produce pain and suffering of the requisite intensity to fall within 2340A's proscription against torture.

    'The Convention' referred to in that paragraph is the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which was ratified by the United States in 1994. As with any treaty ratified by the U.S., the Convention against Torture carries the full force of law.

    Note well the import of that first paragraph from the August 1 memo. The argument leaps blithely over the definitions of torture as described in U.S.C 2340, and proceeds directly to the import of 2340A, the section which demands a 20 year prison term for any American who tortures another human being. If the person being tortured should die, U.S.C. 2340A demands the death penalty for the American responsible.

    The limited series of photographs which has been released from the Abu Ghraib prison in Iraq requires us, as American citizens, to consider carefully those definitions of torture in U.S.C. 2340. They are straightforward and unambiguous, as an American law should be.

    A review of a segment of the photographs released from Abu Ghraib reveals:

Men ordered to masturbate in front of each other and in front of female American soldiers, a humiliating experience which offends their religion (see: "The application of procedures calculated to disrupt profoundly the senses or personality");

 

• Men ordered to simulate homosexual sex with one another, a humiliating experience condemned by their religion (see: "The application of procedures calculated to disrupt profoundly the senses or personality");

• A man, hooded, standing on a box with electrodes attached to his fingers and penis, who was told that if he stepped off the box, he would be electrocuted to death (see: "Prolonged mental harm caused by or resulting from the intentional infliction or threatened infliction of severe physical pain or suffering, the threat of imminent death");

 

• A naked man menaced by, and then attacked by, a vicious dog (see: "Prolonged mental harm caused by or resulting from the intentional infliction or threatened infliction of severe physical pain or suffering, the threat of imminent death");

  

   

• A man lying dead swathed in a plastic bag with two U.S. soldiers grinning up at the camera and flashing a thumbs-up sign (see: "Whoever outside the United States commits or attempts to commit torture shall be fined under this title or imprisoned not more than 20 years, or both, and if death results to any person from conduct prohibited by this subsection, shall be punished by death or imprisoned for any term of years or for life").

   

    This is what we have been allowed to see, but there is more. Seymour Hersh, the reporter who first broke the Abu Ghraib story, spoke recently at the University of Chicago. Hersh is one of the few people alive today who has seen all of the photographic evidence of the torture which took place in that prison. "You haven't begun to see evil," he said, "horrible things done to the children of women prisoners, as the cameras run." Words like "Rape" and "Murder" have been used to describe the evidence which remains as yet unreleased.

    The Bush administration is scrambling to defend itself against accusations that section 2340 has been grossly violated with intent, which means a number of American officials stand in peril of punishment as demanded by section 2340A. Not long ago, administration officials described the barbarism at Abu Ghraib as the rogue behavior of a few wretches, and not a policy deliberately formulated and put into effect. The leaking of memos like that from August 1st, several of which have since been deemed 'Classified' and which Attorney General Ashcroft is refusing to release, prove this defense to be a bald-faced lie.

    The truth is that, beginning as early as 2002, the Bush administration worked long and hard to come up with as many justifications as possible for the horrors we have seen from Abu Ghraib, the purpose of said justifications being to defend Administration officials from the punishments required by law for those who engage in the torture of their fellow human beings. The sum and substance of these defenses would hold that what happened at Abu Ghraib was not torture, and even if it was, the President of the United States can do whatever he wants.

    This broad exculpation of George W. Bush was delineated in another memo, dated March 2003, and titled 'Working Group Report on Detainee Interrogations in the Global War on Terrorism.' In this report, now classified, torture is justified because, "The president's inherent constitutional authority to manage a military campaign" frees him to behave however he wishes. By this rationale, legal prohibitions like those found in U.S.C. 2340 and the Convention against Torture, "must be construed as inapplicable to interrogations undertaken pursuant to his commander in chief authority."

    The March 2003 report goes on to say that torture can be justified by necessity. This 'Doctrine of Necessity' would have us believe that any horror performed against another human being is justified because it supposedly ensures that no more terror attacks will happen. The rationale reaches back to the disgraced and discredited Nuremberg Defense, once put forth by the Nazis, which would pardon dealers of death and agony because they were just following orders. In this case, according to these Bush administration memos, those orders came from a President not bound by law because of the aforementioned Necessity Doctrine.

    There are two clear holes in this disturbing rationale:

1. The Convention against Torture, given the force of American law in 1996, states: "No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture." Simply put, there is no rationale available to George W. Bush or any of his people that removes them from the need to obey the law.
   
   
2. The original reason for the development of these legal excuses for torture came about because American military and intelligence officials felt they were not getting enough information from Taliban and al Qaeda detainees using 'conventional' interrogation techniques. The people tortured in Abu Ghraib, however, were not Taliban, were not al Qaeda, were not capable of perpetrating the kind of terrorist attacks against the United States which created the rationale for this 'Necessity Doctrine' in the first place. Those tortured and killed were not terrorists, but were Iraqi civilians unjustly swept up by American forces. There is no aspect of the 'Doctrine of Necessity' which can justify the torture and murder of innocent people.

    According to the UK Telegraph, the Nuremberg Defense is about to be tested again, but this time it will be the American government under the hammer. A report from the Telegraph dated June 13th states, "New evidence that the physical abuse of detainees in Iraq and at Guantanamo Bay was authorized at the top of the Bush administration will emerge in Washington this week, adding further to pressure on the White House. The Telegraph understands that four confidential Red Cross documents implicating senior Pentagon civilians in the Abu Ghraib scandal have been passed to an American television network, which is preparing to make them public shortly."

    "According to lawyers familiar with the Red Cross reports," continues the Telegraph, "they will contradict previous testimony by senior Pentagon officials who have claimed that the abuse in the Abu Ghraib prison was an isolated incident. 'There are some extremely damaging documents around, which link senior figures to the abuses,' said Scott Horton, the former chairman of the New York Bar Association, who has been advising Pentagon lawyers unhappy at the administration's approach. 'The biggest bombs in this case have yet to be dropped.'"

    These four Red Cross documents will likely become part of the defense being mounted by attorneys representing Lynndie England, the woman featured in several Abu Ghraib photographs. England has been portrayed as some sort of Dragon Lady, one of the wretches who tortured Iraqi civilians all on their own. England's attorneys have put forth a list of 100 witnesses they intend to put on the stand to prove that she was acting under orders, and not on her own. The excuses prepared for George W. Bush and his people, like the August 1 memo and the March 2003 report, support her claim that she was just following orders.

    Some of those witnesses include Vice President Dick Cheney, Defense Secretary Donald Rumsfeld, Deputy Defense Secretary Paul Wolfowitz, Defense Undersecretary for Intelligence Stephen Cambone, Lt. Gen. Ricardo Sanchez, commander of U.S. forces in Iraq, and White House General Counsel Alberto Gonzales.

    It would be the final irony of this matter to have a person like Lynndie England be central to the process of bringing the true barbarians in this horror show to justice. It would be the final irony of this matter to have this woman, who tortured her fellow human beings with a smile on her face, be instrumental in bringing about the final and long-overdue death of the Nuremberg Defense.

On the 27. February in 1933, one month after Adolf Hitler was declared Reichskanzler, the Reichstags-building in Berlin was burning.

When the police arrived they found Marinus van der Lubbe on the premises. After being tortured by the Gestapo he confessed to starting the Reichstag Fire. However he denies that he was part of a Communist conspiracy. Hermann Goering refused to believe him and he ordered the arrest of several leaders of the German Communist Party (KPD). When Hitler heard the news about the fire he gave orders that all leaders of the German Communist Party should "be hanged that very night." Paul von Hindenburg vetoed this decision but did agree that Hitler should take "dictatorial powers". KPD candidates in the election were arrested and Hermann Goering announced that the Nazi Party planned "to exterminate" German communists.

 

As well as Marinus van der Lubbe the German police charged four communists with setting fire to the Reichstag. This included Ernst Torgler, the chairman of the KPD and Georgi Dimitrov of the Soviet Comintern.

Marinus van der Lubbe was found guilty of the Reichstag Fire and was executed on 10th January, 1934. Adolf Hitler was furious he rest of the defendants were acquitted and he decided that in future all treason cases were taken from the Supreme Court and given to a new People's Court where prisoners were judged by members of the National Socialist German Workers Party (NSDAP).

The burning of the Reichstag was very useful for the German Government. On the 28. of February, the Reichstagsbrandverordnung (similiar to Patriot Act) was set in power.

This Decree of the Reich President for the Protection of the People and State abrogates the following constitutional protections.

• Free expression of opinion
• Freedom of the press
• Right of assembly and association
• Right to privacy of postal and electronic communications
• Protection against unlawful searches and seizures
• Individual property rights
• Federal States' right of self-government

A supplemental decree creates the SA (Storm Troops) and SS (Special Security) Federal police agencies.

ANALYSIS

The events in 1933 can be summarized as follows:

• While it is not clear whether the Nazis intentionally set the Reichstag fire in order to create a national crisis, or whether the Nazis simply were opportunistic, the event was used as justification for a sharp curtailment in constitutionally guaranteed civil liberties.
• The Nazis took advantage of the additional Federal police powers to suppress opponents.
• It is clear that in other situations, the Nazis did use the tactic of creating a "law and order" crisis so that they could provide a solution which further eroded civil liberties and entrenched their power.
• The right-wing Nazis and the left-wing communists were cut from the same cloth -- the point is not that the far right destroyed civil rights. Rather, the point is that a democracy can be destroyed by creating a law-and-order crisis and offering as a 'solution' the abdication of civil liberties and state's rights to a powerful but unaccountable central authority.

Post-9/11 laws expand to more than terrorism

Federal and state prosecutors are applying stiff antiterrorism laws adopted after the 9/11 attacks to broad, run-of-the-mill probes of political corruption, financial crimes and immigration frauds.

If the government gets its way, even routine transactions of buying or selling American homes could soon come under the scrutiny of money-laundering provisions of the USA Patriot Act. The Treasury Department, which already has caught up financial transactions in casinos, storefront check-cashing stores and auto dealers for scrutiny, wants to expand Patriot Act coverage to home purchases as well.

Since 9/11, critics say the greatest effect of new state and federal antiterrorism laws has been on crimes already covered by other laws.

Washington-area snipers John Muhammad and Lee Boyd Malvo were both convicted under a post-9/11 Virginia antiterrorism statute making it a death-penalty offense to be involved in more than one murder in a three-year period. Muhammad was sentenced to death, and Malvo was given life imprisonment without parole.

The FBI has used Patriot Act provisions in a political corruption probe involving a Las Vegas girlie bar, and the Justice Department reported to the House Judiciary Committee last year that it used the new law in probes of credit-card fraud, theft from a bank account and a kidnapping.

In the first action of its kind, the Treasury Department also used the Patriot Act this year to put Syria's largest commercial bank and two commercial banks in Myanmar on blacklists - actions that forbid any U.S. financial institution from doing business with them.

Legal experts say they're not surprised that antiterrorism laws are being used for more than just terrorism.

Peter Swire, a law professor at Ohio State University, recalled that Congress adopted antiracketeering laws in 1970 with the intent to thwart mobsters, but the punitive laws have since been broadened and put to use in civil cases against corporations, and most recently against the organized campaigns of pro-life protesters against abortion clinics.

Swire worked in the Clinton administration and chaired a White House working group looking at issues involved with electronic surveillance. He said many Patriot Act provisions, which sped through Congress within days after 9/11, were proposals that either Congress or the White House had previously rejected. Many provisions are slated to expire next year unless Congress makes the changes permanent.

Swire said one little-noted impact of that law on the judicial system is that prosecutors can add more charges against defendants, even when terrorism isn't involved.

"Prosecutors like to have more arrows in their quiver - it gives them more leverage in plea bargaining," he said. Plea bargaining is the process where prosecutors offer to drop some charges in return for a defendant's guilty plea in order to avoid costly, time-consuming trials.

Swire contends the Patriot Act has been so controversial that the Justice Department has been very cautious in using all of its provisions.

"They are careful because they know people are checking to see if it is abused," he said. "Once it becomes permanent, I think it will be used more widely."

The American Civil Liberties Union and other civil rights groups are campaigning for Congress to terminate some of the more controversial provisions of the Patriot Act, contending the law unnecessarily expands government powers.

The ACLU says the government already has sufficient investigative tools, and the Patriot Act has been used for non-terrorist-related crimes such as seizing stolen funds from bank accounts in Belize.

Michael Mello, a law professor at Vermont Law School, disagrees and said the Patriot Act made some needed changes in government procedures, including provisions that tore down barriers that prohibited the FBI and CIA from sharing information.

"There's been a sea change by tearing down that wall," said Mello. "To forbid the FBI from getting spooks' (CIA) information that someone in the United States was carrying out a significant criminal enterprise is insane."

In spite of the criticism from the ACLU and others, Mello said he doesn't believe the Patriot Act has been misused or has resulted in any expansion of government powers. "In the absence of evidence, the critics lose," he said.

Mello agrees that there are some provisions in the Patriot Act that should be allowed to expire. He opposes a controversial provision allowing the Justice Department to use so-called "national security letters" to obtain library records, medical records and banking records of people put under surveillance. The Patriot Act wasn't needed when police searched library records in the hunt for Unabomber Ted Kaczynski or the effort to track New York's Zodiac killer, Mello noted.

Many government activities under the Patriot Act remain shrouded in secrecy. One of the provisions not expiring is an expansion of police powers to obtain "sneak-and-peek" warrants allowing surveillances - including break-ins - without notifying the people being watched.

The government is being more aggressive in asking courts for surveillance warrants. The Justice Department last year made a record 1,727 requests for wiretap approvals from the secretive Foreign Intelligence Surveillance Court, but does not publicly disclose how many investigations that might involve.

Attorney General John Ashcroft told the Senate Judiciary Committee last week that the Patriot Act has been used judiciously, and he urged Congress to give speedy consideration to extending it.

If the navies of the world were putting to sea en masse - and they are (10 carrier groups out from US alone - 93 per cent of ALL US naval ships are at sea - official stats)....

 

And if the Federal Reserve Bank was force-feeding liquidity into the system at rates that exceeded the post-911 period, then a few reasonably sound deductions might be made of this....

 

But first, some assumptions:

 

1) Navies put to sea when they expect severe weather.

 

2) It is very expensive to keep navies at sea for any length of time, and the poorer the country, the shorter the time possible.

 

3) Navies do *not* put to sea en masse for war, especially nuclear war (think about it, the task forces are easy to find. Lob in a nuclear warhead and, voila: no more task force (and no 'collateral

damages or radioactive real estate).

 

4) The Fed forcing money into the system has a short term, limited effect - likely on the order of less than 2 month's cycle time (money velocity through the system).

 

Therefore, our deductions might be as follows:

 

a) Since many of the most powerful nations have sent their naval forces to sea, then whatever the reason for it, it not likely to be a political one.

 

b) Because so many navies are at sea, it seems logical that the powers that be suspect something of a global dimension to occur that would adversely affect ships if there were in port. This argues for both global impact, and climatic/environmental dynamic, as no purely political/social event would affect all navies planet-wide.

 

c) Since navies can only mill-about so long on the water, especially en masse, the 'whatever' is a short-term expectation.

 

d) Since the effects of the Fed liquidity explosion are going to go through the monetary system like heroin through an addict, that is, one short term 'rush' and then withdrawal leading to very shakey behavior, the 'whatever' that the Fed is preparing for is, also likely, a short-term expectation.

 

Of course the definition of 'short-term' could vary, but it would seem safe to assume that the US Navy won't be at sea for months. Perhaps a good definition would be that of a month. And some sort of global navy affecting event may or may not occur.

 

This may suggest the Aussie Bloke stuff, but, today, a single large earthquake in Antarctica rattled the world, setting off a series of quakes along many parts of the Pacific Rim. So, if the navies of the world were expecting something to occur, and thought to be better safe than sorry, they might put,

indeed, put to sea.

 

Since we have two, verified, observable occurances, i.e. navies out to sea, and Fed pumping money like never before in history, we have a logic puzzle. Neither of the observable events makes sense within the context of today's world, unless there is something wicked this way coming.....or thought to be by those we pay to know.
